SCNM’S PRIVACY POLICY

 

SCNM is owned and operated by Soon Cheong Marine Products Sdn Bhd. (“SCNM” or “we”). If the Users supply personal details to SCNM through SCNM’s site, then they have consented to SCNM maintaining, recording, holding and using such personal data in accordance with SCNM Privacy Policy. References to the Application (“Site”) are deemed to include derivatives thereof, including but not necessarily limited to mobile websites and applications. Generally, we use your information for administrative purpose e.g. processing, confirming, fulfilling and completing your transactions and requests for our goods, products or services.

 

All data that SCNM collect and process is stored on servers located in Malaysia, a jurisdiction that may or may not not provide an equivalent level of data protection to the laws in your home country (if outside from Malaysia).

 

On occasion, SCNM may revise this Privacy Policy to reflect changes in the law, SCNM Personal Data collection and use practices, the features of our Site, or advances in technology. If SCNM make revisions that change the way SCNM collect or use the Users Personal Data, those changes will be posted in this Privacy Policy and the effective date will be noted at the beginning of this Privacy Policy or in alternative to be effective with the Users continued usage of this site. Therefore, you should review this Privacy Policy periodically so that you are up to date on SCNM most current policies and practices. SCNM will also prominently post such material changes prior to implementing the change. If the Users do not agree with any changes or modifications to the Privacy Policy, please refrain from continue usage of the Site. FOR AVOIDANCE OF DOUBT THE Users will be deemed to have consented to any modification of the Privacy Policy when you use the Site after the effective date of the modification.

 

 

ACCOUNT REGISTRATION AND INFORMATION

 

Without registration of account with SCNM, the Users are only permitted to browse and maintaining limited access. Should the Users wish to have permissible access, an account must be first registered. To operate an account, the Users must complete the registration process by providing SCNM with current, complete and accurate information as prompted by the Registration Form. The Users are entirely responsible for maintaining the confidentiality of your password and account.

 

Furthermore, the Users are entirely responsible for any and all activities that occur under their account, including but without limitation any payments sent to incorrectly entered information or information that has been compromised due to a breach of security on the account. The Users agree to notify SCNM immediately of any unauthorized use of account or any other breach of security.

 

SCNM will collect the following Personal Data but not limited to the following:-

 

(a)    your name;

(b)   address;

(c)    age;

(d)   phone number;

(e)    e-mail address;

(f)     place of residence and nationality;

 

Incidentally, via other forms of data collection ie: cookies, SCNM also responsible to collect non-personally identifiable information, which may be linked to the Users Personal Data, including

the following;-  

 

(a)    log-in name;

(b)   IP address;

(c)    geographic data;

(d)   operating system type;

(e)    password;

(f)     search preferences related to specific searches;

(g)    other generic Internet usage related data; and

(h)   from the Users when they interact with SCNM through social media.

 

 

MEMBER ACCOUNT, PASSWORD, AND SECURITY

 

MEMBER PRIVACY

 

It is SCNM's policy to respect the privacy of its members. SCNM will not monitor, edit, or disclose any personal information about the Users or the use of the Service, including its contents, without your prior permission unless SCNM has a good faith belief that such action is necessary to:

 

(a)    conform to legal requirements or comply with legal process including the enforcement of the Personal  Data Protection Act 2010;

(b)   protect and defend the rights or property of SCNM;

(c)    enforce the Term of Use; or

(d)   act to protect the interests of its members or others.

(e)    SCNM  bank for authorisation of transaction and for payment

(f)     SCNM subsidiaries and affiliates who may be located in or outside Malaysia.

 

SCNM does provide certain user information in aggregate form to third parties, including its advertisers, for the purpose of demographics. In addition, the Users Internet Protocol address is transmitted with each message sent from the account. Some personal information the Users provide to SCNM may be stored outside of the country in which they reside. The Users agree that SCNM may access the account, including its contents, as stated above or to respond to service or technical issues that may or may not be brought on by the Users.

 

SCNM has no obligation to monitor the Service or any user's use thereof or retain the content of any user session.

 

SCNM will immediately terminate any account, which it believes in its sole discretion, is transmitting or is otherwise connected with any spam or other unsolicited bulk email. Any Spam that is determined to be sent in a malicious manner may result in criminal action against the sender. SCNM will work with its users to combat both inbound and external spam messages. In the event that an account is hijacked, or a password is stolen, the Users should contact SCNM as soon as possible.

 

SCNM does not sell or rent its website users' names, addresses, email addresses or other personal information to any other third party with first obtaining Users consent.

 

 

USAGE OF PERSONAL DATA

 

The Users authorises SCNM to use the Personal Data and other information collected through the Site for the following purposes:-

 

(a)    SCNM Rewards program as requested or where incidental;

(b)   to provide the Users with the requested products and services;

(c)    to provide the Users with information about SCNM products and services on the Site and to communicate with the Users to the extent necessary to provide such requested products and services,;

(d)   to build features that will make the services available on the Site easier to use;

(e)    information will be used for the purposes of accounting (billing and auditing);

(f)     immigration, custom control, safety, security;

(g)    statistical and marketing analysis;

(h)   information systems management, system testing, maintenance and development;

(i)     operational, support, customer surveys, customer relations and to improve and help SCNM in any future dealings with the Users, for example by identifying the Users requirements and preferences.

 

From time to time, SCNM may contact you to request feedback on your experience in using the Site, to assist us in improving the Site, or to offer special savings or promotions to you as a Site user, where you have indicated your consent to receiving such communications.

 

The Users that elected to be member of SCNM, their information will be used to administer the membership and reward the Users in accordance with their eligibility under this Programme.

 

To serve the Users better, SCNM undertake to constantly enhance and expand the services. Be it as it may, to realise that, SCNM may appoint, authorise or contract with strategic business partner and the Users information will be shared to these business partner, authorised or contracted third party, service providers or advertisers to make available promotions, offers, products or services, which may not belong to us.

 

In the event SCNM go through a business transition, such as sale of part or all of SCNM’s assets, merger or acquisition, the Users information will likely form part of this transition and be transferred.

 

USE OF COOKIES

 

Cookies are pieces of information that a website transfers to an individual hard drive for record-keeping purposes; passwords are not saved in cookies. Cookies help SCNM to know which pages are visited most often and help SCNM to ensure that its website responds to users' needs.

SCNM does not use personal identification details transferred through cookies either for promotion or marketing purposes, nor will such information be shared with a third party.

 

SCNM uses a session cookie to keep the Users logged in throughout the visit to the Site.

 

SCNM uses persistent cookies to "personalize" the Site for each user by remembering information about the user's visit to the Site, e.g., the language selected, the log-in details and the search criteria and search results.

 

SCNM also uses persistent cookies or pixel tags to analyze the Users surfing behavior and the visit to the Site enabling SCNM to improve the Site and services and to tailor SCNM advertising (via email, on our Site, and on other websites) according to the interests of the users. Such cookies and pixel tags gather information about the pages the Users visited on the Site and the searches performed during the searches.

 

How You Can Access or Change Your Personally Identifiable Information

 

If the Users would like to review, correct or change the Personal Data that was previously provided to SCNM, or to exercise any right of access, rectification, deletion, or opposition to the processing of your Personal Data that you may have under applicable law, please submit via the site.

 

A Special Note About Minors

 

SCNM encourage parents and guardians to spend time with their children online and to be fully familiar with the sites visited by their children. By using the Site or Services you agree to respond truthfully and accurately about your age. We do not knowingly collect Personal Data from individuals under 18 years of age.  Children under the age of 18 years of age are expressly prohibited from submitting or posting any Personal Data on the Site unless permitted by their parents.

 

Language

 

This Privacy Policy has originally been drawn up in the English language. Translations in other languages are available for your convenience. In case of conflict between the English language version and a translated version, the English language version shall prevail.

SCNM Membership Programme’s Terms and Conditions


1. The ‘SCNM Membership Programme’ (Programme) and ‘SCNM’ Mobile App (Mobile App) is proprietary to SC Neighbourhood Market Sdn Bhd (Company) where acceptance of any person(s) to the Programme shall be subject to the approval of the Company and once accepted by the Company, participation by any such individual (“person”) (Member) in the Programme shall be subject to the terms and conditions contained herein. The Programme is only accepted at Company branded supermarket (Supermarket) situated in Malaysia or the participating merchants that registered with the Company. 

2. By joining the Member Programme, Member will be deemed to have accepted the terms and conditions. These Terms and Conditions shall be applicable and binding on all types of programmes and initiatives under the SCNM’s rewards, including any co-branding arrangements with our respective participating merchants/ partners and that these terms and conditions may be amended, varied, withdrawn, revised, substituted or removed at any time by us at our sole and absolute discretion without notice to you.

3. Participation in the Programme is open to all citizens and non-residents individual only aged 16 years old and above. Not applicable to retailers and bulk purchaser. If the applicant for the membership is below 18 years old, the parent and/or guardian of the minor needs to complete the application form for SCNM membership for and on behalf of the minor. Upon the minor turning 18 years of age and did not cancel the membership that has been created by his/her parent and/or guardian, he/she is deemed to have personally accepted all the terms and conditions for the membership.

4. The point will be awarded for every transaction of RM1 (exclusive of tax) to 1 loyalty Points. Members must spend minimum RM1 and above on qualifying purchases in a single transaction. We reserve the absolute right to substitute and/or replace the award of SCNM points from time to time without any prior notice to the SCNM members and/or to change SCNM points award ratio at any time without any prior notice.

5. Once the Card is credited the loyalty Points corresponding to the Qualifying Purchases, a transaction receipt prepared by the cashier at the checkout counter shall be issued to the Member. Such transaction receipt shall be conclusive record of the Qualifying Purchases made or any refund or cancellation will subject to the cancellation or recall of the rewarded loyalty Points. 


6. During the application process, you will be required to verify your email address. If you do not verify your email address within forty-eight (48) hours from the time you commenced the application process, then your application for the SCNM membership will be incomplete and we will not be able to process or approve your application. 

7. Each member is only entitled to have one (1) Account. Sharing of a single Account with several persons is also not allowed. Whilst the registration for the membership under SCNM rewards is open to the public, we reserve the right to reject any suspicious application without assigning any reasons whatsoever, and our decision shall be final and conclusive.

8. Upon discovery of likelihood of a member in possession of multiple membership, we have the rights to terminate all of the account and only to keep one account with the most loyalty Points. 

9. The following items are not included in the points’ calculation:
a. gift card/cash vouchers purchase, 
b. ePay services, i.e., mobile reload, IDD reload, online game reload, e-wallet reload, Touch ’n Go reload, epay upload, Utilities Bills Payment, Payment to Authorities, etc. 
c. Delivery Charges, Repair & Service Charges
d. Taxes. 

10. The loyalty Points awarded and credited to the Card cannot be transferred or assigned or sell or barter or trade to another Card, individual (member or non-member) or any other card issued by or on behalf of the Company or combined or aggregated with the loyalty Points of such Card or card or otherwise dealt with except in accordance with this Agreement. The loyalty Points have no cash or monetary value.

11. The Points accumulated will expire after 1 year or expiry of 12 months where the points are awarded. All the points will be zeroized and removed from the Member Account on 1st of following month after 1 year or 12 months.


12. An inactive account for over a period of twelve (12) months will result in automatic forfeiture and termination of membership and any or all accumulated reward points. No appeal will be entertained. 

13. "Account activity," for purposes of these terms and conditions, shall be deemed to occur when a member accrues Points in his or her account in any manner set forth in these terms and conditions, or as otherwise approved by SCNM, or when the member redeems any points under SCNM or partner award using Points in the member's account.

14. Member must present their ‘SCNM’ eCard or Membership card to cashier before every transaction. Failure to do, no discount or loyalty Points or entitlement will be awarded for the purchase and no retrospective/ retro-claims will be entertained. 

15. All Coupons/Vouchers have a validity period with an expiry date clearly stated on them. After the expiry date, they cannot be used or reissued. Additional terms and conditions can be found on the Coupons/Vouchers.

16. The Member may refer to the Rewards catalogue available at ‘SCNM’ Mobile App or the participating outlet for redemption, which shall be for the purpose of information and illustration only and shall not be construed as constituting any representation or warranty as to their availability or fitness for purposes. 

17. Accounts must be in good standing and not cancelled, suspended, or terminated by us or cancelled or deactivated by the member at the time of a redemption request.

18. Request for redemption by members with insufficient Points will not be processed.

19. When the member utilises his/her Points for redemption purposes, the Points earned will be deducted by chronological and date order so that the earliest expiring Points will be utilised first, to be followed by the earliest accumulated Points.

20. Upon redeeming a deal or reward, the member releases SCNM from all liabilities in respect of the redemption or use of such deal or reward redeemed under the SCNM rewards programmes. 

21. Any redemption request made and ordered by the member, once accepted cannot be revoked, cancelled, changed, returned, or exchanged by the member. All Points that have been utilised for redemption will not be credited back into the Account. 

22. We assume no responsibility and shall not be held liable for any claims, losses, costs, expenses, or damages of whatever nature resulting from the redemption of any of the deals or rewards by the members. 

23. For Rewards that are to be redeemed from participating merchants or suppliers of Rewards as shall be appointed by the Company from time to time, the Member shall present his/her Card and national identity card (NRIC) for Rewards redemption.

24. Member who has redeemed his/her points for any rewards, i.e., merchant products or services, is not eligible for refund or cancellation from the Company.

25. Company reserves the rights to reject any request for the replacement of faulty or damaged Rewards should the Member fail to return the same in the manner and within the time set out as stated above. The Company has the right to request the Member to liaise directly with the participating merchant for any replacement of defective or damaged rewards. 

26. you warrant and represent that all the personal information provided by you to us is true, correct, up to date and complete. You acknowledge and agree that we will need to collect and process your personal information for us to provide the services and privileges under the SCNM’s rewards, and to manage your Account.

27. To enable you to participate in the SCNM’s rewards, the sharing, transfer, retrieval, updating and processing of your personal information and data as well as creation of member profile and user accounts may occur between SCNM and its Affiliates, associates, licensees, vendors, service providers, Merchants, strategic partners or any third-party contractors, within Malaysia.

28. By applying to be an SCNM’s member, you agree that you have read, understood, and consented to the collection and processing of your personal information for the purposes set out herein in connection with your membership under the SCNM’s rewards programme. 

29. The Member agree that the Personal Data may be used by Company for the purposes below.
a. To associate the Card to the Member and to update information (if required);
b. To process the application by the Member for related services;
c. Management, operation and maintenance of Member's account, system including audit and exercising the rights of the Company under the terms and conditions;
d. Designing new or improving existing services provided by Company, our subsidiaries, associates and affiliates;
e. Communication by Company to Member;
f. Investigation of complaints, suspected suspicious transaction and research for service improvement;
g. Automatic subscription for Marketing purposes; 
h. Prevention or detection of crime or fraud; and
i. Disclosure as required by law, rules, regulations, codes or guidelines.

30. Members deemed to have subscribed to the marketing mailing list upon registered as a ‘Member’ and the Company will send or deliver the marketing information and relevant updates (“Newsletter(s)”) via push notification, SMS, electronic direct mail (e-DM) and/or direct mail (DM). 

31. The Member may terminate his/her membership anytime by giving notice in writing to the Company. However, there will be no refund of points collected in any form for termination of membership.

32. We shall not be liable for any loss or damage suffered because of any defect or error in any machines or inability to retrieve any information or data from the computer system. You should frequently review your Account to check and verify your current points balance. 

33. We will, in most cases, credit its members' accounts with the rightful accumulated reward points. However, members are fully responsible to maintain their own account and ensure that reward points are credited accordingly. Should a member find that Points have been earned but were not rightfully credited, or in cases where SCNM deems verification is required, SCNM reserves the right to require proof of accrual from the member, including but not limited to copies of receipts or similar documentation verifying any transaction claimed to have been performed. Any claims for rewards points by the member and proof of accrual must be received by SCNM within 30 days after the date such rewards points were claimed to be earned. 

34. Company shall not be liable howsoever for any errors, delays, loss or damage, which may be directly or indirectly due to breakdown, failure of machinery or the processor; or industry dispute, war, act of God, system failure and anything outside the control of the Company.

35. Company shall not be liable for any loss or damage suffered by the Member due to the following reasons:
a. any failure by the Reward supplier to abide by the terms and conditions on which it has agreed to provide the Reward;
b. any statement, communication or implication arising from any revocation, suspension or restriction of the use of the Card; and
c. any failure or omission to notify the Member of any changes in the terms and conditions of this Agreement, Rewards Guide, participating companies, Qualifying Purchases and The Points awarded for Qualifying Purchases.
d. Any warranty or fitness for the purposes. 

36. IF WE OR OUR REWARDS PARTNER IMPROPERLY DENIES A MEMBER AN ACCRUAL OR BENEFIT, OUR LIABILITY WILL BE LIMITED TO THE EQUIVALENT OF THAT ACCRUAL OR BENEFIT AND NOT MORE. 

37. By subscribing for the membership, you agree and undertake: - 
(a) not to use the SCNM member ID for any unlawful and/or fraudulent activities; 
(b) not to engage in misconduct, including, but not limited to fraudulent acquisition or earning of SCNM points or unauthorised sale/ redemption or abuse of SCNM points, unauthorised sale/ redemption or abuse of any benefits including but not limited fraudulent earning and/or redemption of SCNM points; 
(c) not to breach any rules governing the SCNM rewards (including specific terms and conditions governing initiatives or programmes under SCNM rewards); and 
(d) to only use the SCNM member ID in accordance with the terms and conditions of this Terms and Conditions. If we have reasonable reasons to believe that your SCNM’s member ID has been used for unauthorised commercial activities with a view to profit, in contravention of this Terms and Conditions or for purposes which are unacceptable to us, we shall be entitled to suspend, block and/or terminate your membership (including forfeiture of accumulated  points) and/or cancellation of transactions performed under your membership (including transactions related to such unauthorised commercial activities) immediately without prior notice to you or providing any reason to you. 
(e) Malaysia as the exclusive jurisdiction. 

38. THE PROGRAM AND POINTS ARE PROVIDED "AS-IS," WITHOUT WARRANTY OR REPRESENTATION OF ANY KIND. THE COMPANY DISCLAIMS ALL WARRANTIES AND REPRESENTATIONS OF ANY KIND WHATSOEVER, WHETHER WRITTEN OR ORAL, EXPRESS, IMPLIED, STATUTORY, OR ARISING BY OPERATION OF LAW, COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, WITH RESPECT TO THE PROGRAM AND THE POINTS.
