PERSONAL DATA PRIVACY NOTICE
SOON CHEONG MARINE PRODUCTS SDN. BHD. (367537-U) (“SC WHOLESALE”) respects and values the privacy of individuals with regards to personal data and strive to protect the same in accordance to the Personal Data Protection Act 2010 (“the Act”). As part of SC WHOLESALE’s efforts to protect your personal data, this Personal Data Privacy Notice is formulated in accordance with the Act. For the purpose of this Personal Data Privacy Notice, “Personal Data” shall have the meaning as ascribed in the Act.
This Personal Data Privacy Notice applies to any person whose Personal Data is processed by SC WHOLESALE including but not limited to SC WHOLESALE’s customers, employees, suppliers and tenants.
* 1. This Personal Data Notice serves to inform you how your Personal Data is being processed by and/or on behalf of SC WHOLESALE.
* 2. The Personal Data processed by SC WHOLESALE may include your name, contact details, date of birth, email address and any other personal data required for the purposes set out in the paragraph below.
* 3. Your Personal Data may be collected from various sources, including but not limited to information you have provided to SC WHOLESALE, information from third parties and information in the public domain.
PURPOSE OF COLLECTION OF PERSONAL DATA
SC WHOLESALE may collect, retain and use your Personal Data for among others the following purposes (“the Purposes”):
* a) providing you with services under any SC WHOLESALE's businesses;
* b) processing your application under any SC WHOLESALE's programmes;
* c) providing you with ongoing information about events and programmes, SC WHOLESALE’s products, services, special offers, new products, updates and promotions;
* d) conducting research, develop and improve our events, programmes, products and services including but not limited to historical and statistical record keeping purposes;
* e) discharging SC WHOLESALE’s contractual obligations;
* f) creating directories, databases or information technology system for SC WHOLESALE’s internal and retail business operation;
* g) resolving concerns and complaints;
* h) recruitment purposes; and
* i) for any other purpose that is incidental or ancillary or in furtherance to SC WHOLESALE’s internal and daily retail business operation.
DISCLOSURE
SC WHOLESALE may disclose your Personal Data to among others, the following parties as stated below for the Purposes:-
* a) SC WHOLESALE’s parent company, subsidiaries, related and associated companies;
* b) SC WHOLESALE’s licensees, co-organisers of events, business alliances, agents and service providers (including those located overseas);
* c) any relevant authorities or bodies;
* d) auditors, professional advisories;
* e) to such person pursuant to the requirements of any law, if such action is necessary to (i) comply with the requirement of any law enforcement agency, court order or legal process; or (ii) protect and defend rights or property of SC WHOLESALE,
* f) the employees from SC WHOLESALE’s parent company, subsidiaries, related and associated companies; and
* g) any other person and/or organisations which SC WHOLESALE may think fit.
Notwithstanding that any such persons may be outside Malaysia, your personal data is to be disclosed at the time of its collection or for any other purposes directly related to any of the above Purposes or where such disclosure is required or authorised by law or by the order of a court.
SAFETY OF PERSONAL DATA
Efforts will be made to ensure that any Personal Data held by SC WHOLESALE is kept up-to-date and is protected against any loss, misuse, modification, unauthorised or accidental access or disclosure, alteration or destruction.
SC WHOLESALE may regularly reviewed the security measures in safe keeping your Personal Data and only authorised staffs of SC WHOLESALE who have been duly trained are allowed to handle the Personal Data.
RETENTION OF PERSONAL DATA
Any Personal Data supplied by you will be retained by SC WHOLESALE for a period SC WHOLESALE deems fit and necessary for the fulfilment of the Purposes or is required to satisfy legal regulatory, accounting requirements or to protect SC WHOLESALE's interests (“the Retention Period”).
Upon expiry of the Retention Period and/or after SC WHOLESALE cease to process your Personal Data, SC WHOLESALE will take all necessary action to permanently delete and destroy your Personal Data.
RIGHT OF ACCESS TO PERSONAL DATA
In accordance with the Act, you may request to access and/or modify and/or alter and/or update your Personal Data, subject to the followings:
* a) SC WHOLESALE may charge an administration fee for processing your request for access; and
* b) SC WHOLESALE may refuse to comply with your request for access or correction in accordance with the Act.
DISCLAIMERS
* a) By providing SC WHOLESALE your Personal Data, you hereby consent to the processing of your Personal Data in accordance with all of the foregoing (“the Consent”).
* b) SC WHOLESALE may cease to process your Personal Data within a reasonable period upon receiving your written notice pertaining to the withdrawal of the Consent.
* c) SC WHOLESALE’s website may contain links to other sites and pages. By activating a link, such as for example by clicking on the banner of an advertiser, you leave SC WHOLESALE’s website and SC WHOLESALE does not exercise control over any Personal Data or any other information you give to any other entity after you have left SC WHOLESALE’s website.
* d) Any questions, comments, suggestions or information other than Personal Data sent or posted to the site, or any part of the site by visitors will be deemed voluntarily provided to SC WHOLESALE on a non-confidential and non-proprietary basis. SC WHOLESALE reserves the right to use, reproduce, disclose, transmit, publish, broadcast and/or post elsewhere such information freely, including passing it to any associated company, in connection with the development, manufacture and marketing of products and services and to meet customer needs.
* e) SC WHOLESALE reserve the rights at any time to add, change, update or modify this Personal Data Privacy Notice, simply by informing such change, update or modification via mail, short message service, posting on the website and such other notifications as SC WHOLESALE may deemed fit. Any such change, update or modification will be effective immediately upon posting on the website.
* f) Please note that in the event your Personal Data is not sufficiently supplied, or is not satisfactory to SC WHOLESALE, your application or request to SC WHOLESALE for any of the Purposes may not be accepted.
The ‘SC Family Member Programme’ (Programme) and ‘SC Wholesale’ Mobile App (Mobile App) are proprietary to Soon Cheong Marine Products Sdn Bhd. (Company) where acceptance of any person(s) to the Programme shall be subject to the approval of the Company and once accepted by the Company, participation by any such person (Member) in the Programme shall be subject to the terms and conditions contained herein. The Programme is only accepted at Company branded supermarket (Supermarket) situated in Malaysia or the participating merchants that registered with the Company.
In order to become a Member, the applicant must agree to the terms and conditions. The Company reserves the rights to make amendments or variations to the terms and conditions from time to time.
Participation in the Member Programme is open to all citizens and non-residents aged 18 years old and above.
Each person can only register and own one SC Family card at any one time. The Member Card is not transferable and can only be used by the rightful owner.
The SC Family Card can be used to collect Points and make redemption at SC Wholesale, Klang store only.
The registration of Mobile App is Free and registration of Physical Member Card is RM10.
This is a lifetime membership programme. Member who does not make any purchase or collect any point for 12 consecutive months will be removed from the Programme and all points and unused rewards or Vouchers will be deleted. Member will need to re-apply for new membership should they wish to re-join the programme.
For replacement of damaged/lost Physical Member Card, there will be a charge of RM10.
Every transaction of RM1 (exclusive of tax) will be awarded 1 SC Family Point. Members must spend a minimum of RM1 and above on qualifying purchases in a single transaction.
Purchase of the following items will not be entitled for SC Family Points:
Government controlled items (oil, flour, rice, sugar and etc.),
gift card/cash vouchers/SC merchandise purchase,
ePay services, i.e., mobile reload, IDD reload, online game reload, e-wallet reload, Touch ’n Go reload, ePay upload, Utilities Bills Payment, Payment to Authorities, etc.
Delivery Charges, Repair & Service Charges,
Once the Card is credited the SC Family Points corresponding to the Qualifying Purchases, a transaction receipt prepared by the cashier at the checkout counter shall be issued to Members. Such transaction receipt shall be conclusive record of the Qualifying Purchases made as for the Points accumulated will be shown at the membership account within 24 hours. Members will be able to check up to 6 months loyalty transaction available at the SC Wholesale Mobile App.
The SC Family Points awarded and credited to the Card cannot be transferred or assigned to another Card or any other card issued by or on behalf of the Company or combined or aggregated with the Points of such Card or card or otherwise dealt with except in accordance with this Agreement. The Points have no cash or monetary value.
Members must present their SC Family Card to cashier before every transaction. Failure to do so, no point will be awarded for the purchase made.
The SC Family Points accumulated will expire after 2 Calendar Years from the Calendar Year where the points are awarded. All the points will be zeroized and removed from the Member Account on 1st January of 3rd Calendar Year. For example,

All terms and conditions of SC Wholesale ‘Return Policy’ will be applied to all purchases made by SC Family Card. If a Member refunds/returns any item for which SC Family points have been credited, corresponding number of SC Family points for the items returned will be removed from the Member’s account.
E-Gift Voucher has a validity period of 90 days with Expiry Date stated in the E-Gift Voucher, beyond which they cannot be used or reissued. Additional terms and conditions may be found at the E-Gift Voucher.
All redeemed E-Gift Voucher via SC Wholesale Mobile App can be used on the following day upon redemption.
The Member may refer to the Rewards catalogue available at SC Wholesale Mobile App or the participating outlet for redemption, which shall be for the purpose of information and illustration only and shall not be construed as constituting any representation or warranty as to their availability.
The Company gives no representation or warranty with respect to any products and/or services featured in the Rewards catalogue. Where the Rewards are covered under any manufacturers' warranty, any disputes or claims shall be forwarded directly to the manufacturers concerned.
For Rewards that are to be redeemed from participating merchants or suppliers of Rewards as shall be appointed by the Company from time to time, the Member shall present his/her Card and national identity card (NRIC) for Rewards redemption.
Member who has redeemed their points for any SC Wholesale Gift Vouchers, are not eligible for refund or cancellation from the Company.
Member is responsible to examine, immediately upon receipt, the voucher for any damage. If the Voucher is found to be incomplete / damage, it needs to be exchanged on the spot.
The Company reserves the rights to reject any request for the replacement of damaged voucher should the Members fail to return the same in the manner and within the time period set out as stated above.
It is the Members’ responsibility to notify the SC Family Management of any changes of personal particulars, lost or damaged card.
Member needs to update or correct the provided personal data via SC Wholesale Mobile App from time to time.
Member is deemed to agree that the Personal Data may be used by the Company for the purposes below.
To associate the Card to Members and to update information (if required);
To process the application by Members for related services;
Management, operation and maintenance of Members' accounts, system including audit and exercising the rights of the Company under the terms and conditions;
Designing new or improving existing services provided by the Company, our subsidiaries, associates and affiliates;
Communication by the Company to Members;
Investigation of complaints, suspected suspicious transaction and research for service improvement;
Prevention or detection of crime or fraud; and
Disclosure as required by law, rules, regulations, codes or guidelines.
Member is deemed to have subscribed to the marketing mailing list upon registered as a ‘Member’ in the App and the Company will send or deliver the marketing information and relevant updates (“Newsletter(s)”) via push notification, SMS, electronic direct mail (e-DM) and/or direct mail (DM).
Member may terminate his/her membership anytime by giving notice in writing to the Company. However, there will be no refund of registration fee or points collected in any form for termination of membership.
Any abuse or fraud with respect to The Points under the Programme or redemption of Rewards will result in the cancellation of Members' participation in the Programme, cancellation of the Card and revocation of The Points or return of redeemed Rewards (or its reasonable compensation thereto).
The Company reserves the right to restrict, suspend, or change the features and benefits of the membership programme, including the terms and conditions from time to time without prior notice or assigning any reasons.
The Company shall not be liable for any loss of accumulated The Points or loss or damage suffered as a result of any defect or error in any machines or inability to retrieve any information or data from the computer system.
The Company shall not be liable howsoever for any errors, delays, loss or damage, which may be directly or indirectly due to breakdown, failure of machinery or the processor; or industry dispute, war, act of God, system failure and anything outside the control of the Company.
The Company shall not be liable for any loss or damage suffered by Members due to the following reasons:
any statement, communication or implication arising from any revocation, suspension or restriction of the use of the Card; and
any failure or omission to notify Members of any changes in the terms and conditions of this Agreement, Rewards Guide, participating companies, Qualifying Purchases and The Points awarded for Qualifying Purchases.
