MEGAMART SDN. BHD. (1047844-A) (hereinafter referred to as “MEGAMART”)
is committed to prevent personal data of individuals being used in an
inappropriate manner, and ensure compliance with legal, and regulatory
requirements for data protection, and privacy.
1.0 General
Personal data means information in respect of commercial
transactions that relates to directly or indirectly to a Data Subject, who is
identified or identifiable from that information or from that and other
information in the possession of a data user, including any sensitive personal
data, and expression of opinion about the Data Subject. Such personal
information about or which identifies individual(s) who is the Data Subject,
includes but not limited to individual(s)’ names, addresses, identity card numbers
(MyKad), passport numbers, telephone and/or fixed line numbers, photographs,
and email and/or social media addresses.
Processing in relation to personal data means collecting,
recording, holding or storing the personal data or carrying out any operation
or set of operations on the personal data.
Sensitive personal data means any personal information
consisting information including but not limited to the physical or mental
health or condition of a Data Subject, his political opinions, his religious
beliefs or other beliefs of a similar nature, the commission or alleged
commission by him of any offence or any other personal data.
Data Subject refers to individual who is the subject of the
personal data.
2.0 Notice and Choice
MEGAMART collects personal data directly from the Data
Subject, and in this context, from you through registration or feedback form or
any contest participation.
MEGAMART processes various types of personal data including
but not limited to individual’s names, addresses, identity card (MyKad)
numbers, passport numbers, telephone numbers and/or fixed line numbers,
photographs and e-mail addresses and/or social media addresses.
MEGAMART shall process the personal data for the following
purposes (which may also include purposes directly related to the said
purposes):
- Providing
you with service under MEGAMART’s business which includes any matters
relating to exchange of goods or services;
- Processing
your application or registration under any MEGAMART’s program; and for the
purpose of exercising or performing any right or obligation which is
conferred or imposed by law on MEGAMART in connection with candidates for
employment including personal data relating to other individuals who may
be identified from the personal data.
- MEGAMART
may disclose personal data to third parties for legitimate business
purposes, including for the following purposes or in the following
circumstances: –
- Background
verification checks on candidates for employment;
- Relating
to advertising, publicity, marketing and communication related to MEGAMART;
- For
the purposes of exercising or performing any right or obligation which is
conferred or imposed by law on MEGAMART in connection with candidates for
employment including any referee whose personal date are provided by you;
and
- Making
such disclosures as may be required by law or by order of a court of
competent jurisdiction or by any rule, direction or regulation of any
regulatory or governmental authority or any other relevant authority to
be disclosed.
- MEGAMART
would like to notify that it’s obligatory for you to supply the personal
data in order for us to provide you with services which includes any
matters relating to exchange of goods or services, to process your
application or registration under any MEGAMART’s program, and to process
your application in relation of employment application under MEGAMART. MEGAMART
will not be able to provide you with the adequate services if you fail to
supply the personal data.
- Where
sensitive personal data is provided, and disclosed by you to MEGAMART, by
such disclosure, you have consented to its collection and processing by MEGAMART.
- You
hereby represent that if at any time you have provided, and disclosed to MEGAMART
personal data about other individuals, you are authorized to do so, and we
are aware that MEGAMART may use, and/or process such personal data for the
relevant purpose as set out in “ITEM 3” above.
- You
may be notice in writing to MEGAMART withdraw your consent to or limit the
processing of personal data in respect of which you are the Data Subject. MEGAMART
shall upon receiving the written notice cease or limit the processing of
the personal data accordingly. Please refer to the “Access” section below
for the communication methods available.
3.0 Disclosure
Personal data shall not without your consent be disclosed
for any purpose other than the purpose for which the personal data was to be
disclosed at the time of collection of the personal data or a purpose directly
related to it, or be disclosed to a third party other than that specified in
the “Notice and Choice” section above.
4.0 Security
MEGAMART shall take appropriate measures to protect the
personal data from any loss, misuse, modification, unauthorized or accidental
access or disclosure, alteration or destruction when processing personal data.
5.0 Retention
MEGAMART retains personal data for as long as necessary for
its legitimate business purposes, and as otherwise permitted by applicable law.
6.0 Data Integrity
Personal data supplied by you to MEGAMART shall be accurate,
complete, and not misleading.
7.0 Access
You have the right to request access to your personal data
processed by MEGAMART, and be able to correct that personal data at MEGAMART’s

MEGAMART SDN. BHD. (1047844-A) (selepas ini dirujuk sebagai
“MEGAMART”) adalah komited untuk mencegah penyalahgunaan data peribadi individu
dan memastikan undang-undang, dan peraturan perlindungan data, dan privasi
dipatuhi.
1.0 Umum
Data peribadi bermaksud maklumat mengenai transaksi komersil
yang berkaitan secara langsung atau tidak langsung dengan Subjek Data yang
dikenalpasti atau boleh dikenalpasti melalui maklumat tersebut atau
maklumat-maklumat lain di dalam simpanan pengguna data, termasuklah data
peribadi sensitif dan sebarang pendapat tentang Subjek Data. Maklumat peribadi
tersebut mengenai atau yang mengenal pasti individu iaitu Subjek Data
termasuklah tetapi tidak terhad kepada nama, alamat, nombor kad pengenalan
(MyKad), nombor pasport, nombor telefon dan alamat e-mel dan/atau alamat media
sosial.
Pemprosesan berkaitan dengan data peribadi bermaksud
mengumpul, merekod, memegang atau menyimpan data peribadi atau menjalankan
apa-apa operasi atau operasi-operasi ke atas data peribadi.
Data peribadi sensitif bermaksud sebarang maklumat peribadi
yang terdiri daripada maklumat termasuk tetapi tidak terhad kepada kesihatan
atau keadaan fizikal atau mental Subjek Data, pendapat politiknya, kepercayaan
agamanya atau kepercayaan lain yang serupa, perbuatan salah atau perbuatan
salah yang dituduh ke atasnya atau apa-apa data peribadi yang lain.
Subjek Data merujuk kepada individu yang menjadi subjek
kepada data peribadi.
2.0 Notis dan Pilihan
MEGAMART mengumpul data peribadi secara langsung daripada
Subjek Data, dan dalam konteks ini, daripada anda melalui sebarang bentuk
borang permohonan, pendaftaran atau maklum balas secara atau dari penyertaan
peraduan.
MEGAMART memproses pelbagai jenis data peribadi termasuklah
tetapi tidak terhad kepada nama, alamat, nombor kad pengenalan (MyKad), nombor
pasport, nombor telefon, gambar dan alamat e-mel dan/atau alamat media sosial.
MEGAMART akan memproses data peribadi bagi tujuan yang
berikut (yang mungkin juga termasuk tujuan-tujuan berkait secara langsung
dengan tujuan tersebut):
- menyediakan
anda dengan perkhidmatan di bawah perniagaan yang termasuk sebarang
perkara yang berhubungan kait dengan pertukaran barangan atau perkhidmatan
MEGAMART;
- memproses
permohonan atau pendaftaran anda di bawah mana-mana program MEGAMART; dan
- bertujuan
untuk menjalankan atau melaksanakan apa-apa hak atau kewajipan yang
dikenakan oleh undang-undang ke atas MEGAMART berkaitan dengan calon-calon
untuk pekerjaan termasuklah data peribadi individu-individu lain yang
boleh dikenal pasti daripada data peribadi tersebut.
- MEGAMART
dibenarkan untuk mendedahkan data peribadi kepada pihak ketiga untuk
tujuan perniagaan yang sah, termasuk bagi tujuan yang berikut atau dalam
keadaan berikut:
- pemeriksaan
pengesahan latar belakang calon-calon untuk pekerjaan;
- berkenaan
pengiklanan, publisiti, pemasaran dan komunikasi sehubungan dengan MEGAMART;
- untuk
tujuan menjalankan atau melaksanakan apa-apa hak atau kewajipan yang
dikenakan oleh undang-undang ke atas MEGAMART berkaitan dengan
calon-calon untuk pekerjaan termasuk mana-mana data peribadi
individu-individu rujukan (referees) yang disediakan oleh anda; dan
- membuat
pendedahan seperti yang dikehendaki oleh undang-undang atau oleh perintah
mahkamah yang mempunyai bidangkuasa atau oleh mana-mana peraturan, arahan
atau peraturan oleh mana-mana pihak berkuasa yang berwajib atau kerajaan
atau mana-mana pihak berkuasa lain yang berkaitan.
- MEGAMART
memaklumkan bahawa anda berkewajipan untuk memberi data peribadi supaya
kami dapat menyediakan anda dengan perkhidmatan di MEGAMART termasuk
sebarang perkara yang berhubungan kait dengan pertukaran barangan atau
perkhidmatan, untuk memproses permohonan atau pendaftaran anda di bawah
mana-mana program MEGAMART, dan untuk memproses permohonan anda berhubung
dengan permohonan pekerjaan di MEGAMART. MEGAMART tidak akan dapat untuk
menyediakan anda dengan perkhidmatan lengkap jika anda gagal untuk
memberi data peribadi yang dikehendaki.
- Jika
data peribadi sensitif diberikan, dan didedahkan oleh anda kepada MEGAMART,
ia bermaksud dengan pendedahan sedemikian, anda telah mengizinkan
pengumpulan, dan pemprosesan data peribadi sensitif tersebut oleh MEGAMART.
Anda dengan ini menjamin bahawa jika pada bila-bila masa
anda telah memberikan, dan mendedahkan kepada MEGAMART data peribadi tentang
individu-individu yang lain, anda adalah dibenarkan untuk berbuat demikian, dan
mengetahui dan sedia maklum bahawa MEGAMART boleh menggunakan, dan/atau
memproses data peribadi itu bagi tujuan-tujuan yang berkaitan seperti yang
dinyatakan dalam “Perkara 3” di atas.
Anda boleh melalui notis bertulis kepada MEGAMART menarik
balik keizinan anda kepada pemprosesan data peribadi atau menghadkan
pemprosesan data peribadi oleh MEGAMART dimana anda adalah Subjek Data. Apabila
MEGAMART telah menerima notis bertulis tersebut hendaklah memberhentikan atau
menghadkan pemprosesan data peribadi. Sila rujuk kepada bahagian “Akses” di
bawah untuk kaedah komunikasi yang disediakan untuk berhubung dengan MEGAMART.
3.0 Pendedahan
Data peribadi tidak boleh didedahkan tanpa keizinan anda
untuk apa-apa tujuan selain daripada tujuan asal yang diizinkan dimana data
peribadi tersebut boleh didedahkan pada masa pengumpulan data peribadi tersebut
atau tujuan yang berkait secara langsung dengannya. Data peribadi juga tidak
boleh didedahkan kepada pihak ketiga selain daripada yang dinyatakan dalam
bahagian “Notis dan Pilihan” di atas.
4.0 Keselamatan
MEGAMART akan mengambil langkah-langkah yang sesuai untuk
melindungi data peribadi daripada sebarang kehilangan, penyalahgunaan,
pengubahsuaian, akses atau pendedahan yang tidak dibenarkan atau yang tidak
disengajakan, pengubahan atau pemusnahan apabila memproses data peribadi.
5.0 Penyimpanan Rekod
MEGAMART menyimpan data peribadi selagi perlu untuk tujuan
perniagaan yang sah, atau jika sebaliknya dibenarkan oleh undang-undang yang
berkenaan.
6.0 Integriti Data
Data peribadi yang diberikan oleh anda kepada MEGAMART hendaklah
benar dan tepat, lengkap, dan tidak mengelirukan.
7.0 Akses
Anda mempunyai hak untuk meminta akses kepada data peribadi
anda yang diproses oleh MEGAMART, dan untuk membetulkan data peribadi tersebut
di cawangan-cawangan MEGAMART yang tertera dibawah:

8.0 Pertanyaan

Megamart Membership Programme’s Terms And Conditions:
1.
The ‘Megamart Membership Programme’
(Programme) and ‘Pasaraya Mega’
Mobile App (Mobile App) is proprietary to Megamart Sdn Bhd (Company) where acceptance of any person(s) to
the Programme shall be subject to the approval of the Company and once accepted
by the Company, participation by any such person (Member) in the Programme
shall be subject to the terms and conditions contained herein. The Programme is
only accepted at Company branded supermarket (Supermarket) situated in Malaysia
or the participating merchants that registered with the Company.
2. In
order to become a Member, the applicant must agree to the terms and conditions.
The Company reserves the right to make amendments or variations to the terms
and conditions from time to time.
3. Participation
in the Programme is open to all citizens and non-residents aged 18 years old
and above.
4.
The Member will be entitled for
the Membership for a period of 1 year. Member is required to renew membership
at RM5.
5.
The point will be awarded for every
transaction of RM1 (exclusive of tax) to 1 loyalty Points. Members must spend
minimum RM1 and above on qualifying purchases in a single transaction.
6.
Once the Card is credited the loyalty Points
corresponding to the Qualifying Purchases, a transaction receipt prepared by
the cashier at the checkout counter shall be issued to the Member. Such
transaction receipt shall be conclusive record of the Qualifying Purchases made.
7. Each
person can only register and own one Member Card at any one time. The Member
Card is not transferable and can only be used by the rightful owner.
8. The
following items are not included in the points’ calculation:
a.
gift card/cash vouchers purchase,
b.
ePay services, i.e., mobile reload, IDD
reload, online game reload, e-wallet reload, Touch ’n Go reload, epay upload,
Utilities Bills Payment, Payment to Authorities, etc.
c.
Delivery Charges, Repair & Service Charges
9. The
loyalty Points awarded and credited to the Card cannot be transferred or
assigned to another Card or any other card issued by or on behalf of the
Company or combined or aggregated with the loyalty Points of such Card or card
or otherwise dealt with except in accordance with this Agreement. The loyalty
Points have no cash or monetary value.
10.
The Points accumulated will expire after 2 Calendar Years from the Year where the
points are awarded. All the points will be zeroized and removed from the Member
Account on 1st of following month after 2 Calendar Years.
For example,
11. Member must present their ‘Pasaraya Mega’ eCard or
Membership card to cashier before every transaction. Failure to do, no point
will be awarded for the purchase.
12. The Member may refer to the Rewards catalogue available at ‘Pasaraya Mega’ Mobile App or the participating outlet for
redemption, which shall be for the purpose of information and illustration only
and shall not be construed as constituting any representation or warranty as to
their availability.
13. The Company gives no representation or warranty with respect to
any products and/or services featured in the Rewards catalogue. Where the
Rewards are covered under any manufacturers' warranty, any disputes or claims
shall be forwarded directly to the manufacturers concerned.
14. For Rewards that are to be redeemed from participating merchants
or suppliers of Rewards as shall be appointed by the Company from time to time,
the Member shall present his/her Card and national identity card (NRIC) for
Rewards redemption.
15. Member
who has redeemed his/her points for any rewards, i.e., merchant products or
services, is not eligible for refund or cancellation from the Company.
16. The
Points awarded and credited to the Card cannot be transferred or assigned to
another Card or any other card issued by or on behalf of the Company or
combined or aggregated with the Points of such Card or card or otherwise dealt
with except in accordance with this Agreement. The Points have no cash or
monetary value.
17. The
Member is responsible to examine, immediately upon receipt, the Rewards for any
defects or damage, whether in its packaging or otherwise, and to verify the
contents of the Rewards. Where the Reward or its packaging is found to be
damaged or defective or that the contents therein is incomplete / damage, the
Rewards be immediately returned the Rewards to the Customer Service at the
Supermarket.
18.
Company reserves the rights to reject any
request for the replacement of faulty or damaged Rewards should the Member fail
to return the same in the manner and within the time period set out as stated
above.
19.
Member need to update or correct the provided personal
data via ‘Pasaraya Mega’
Mobile App from time to time.
20. The
Member agree that the Personal Data may be used by Company for the purposes
below.
a.
To associate the Card to the Member and to
update information (if required);
b.
To process the application by the Member for
related services;
c.
Management, operation and maintenance of
Member's account, system including audit and exercising the rights of the
Company under the terms and conditions;
d.
Designing new or improving existing services
provided by Company, our subsidiaries, associates and affiliates;
e.
Communication by Company to Member;
f.
Investigation of complaints, suspected
suspicious transaction and research for service improvement;
g.
Prevention or detection of crime or fraud; and
h.
Disclosure as required by law, rules,
regulations, codes or guidelines.
21. Members
deemed to have subscribed to the marketing mailing list upon registered as a
‘Member’ and the Company will send or deliver the marketing information and
relevant updates (“Newsletter(s)”) via push notification, SMS, electronic
direct mail (e-DM) and/or direct mail (DM).
22. The
Member may terminate his/her membership anytime by giving notice in writing to
the Company. However, there will be no refund of points collected in any form
for termination of membership.
23. Any
abuse or fraud with respect to The Points under the Programme or redemption of
Rewards will result in the cancellation of the Member's participation in the
Programme, cancellation of the Card and revocation of The Points or return of
redeemed Rewards (or its reasonable compensation thereto).
24. The
Company reserves the right to restrict, suspend, or change the features and
benefits of the membership programme, including the terms and conditions from
time to time without prior notice or assigning any reasons.
25. Company
shall not be liable for any loss of accumulated The Points or loss or damage
suffered as a result of any defect or error in any machines or inability to
retrieve any information or data from the computer system.
26.
Company shall not be liable howsoever for any
errors, delays, loss or damage, which may be directly or indirectly due to
breakdown, failure of machinery or the processor; or industry dispute, war, act
of God, system failure and anything outside the control of the Company.
27.
Company shall not be liable for any loss or
damage suffered by the Member due to the following reasons:
a.
any failure by the Reward supplier to abide by
the terms and conditions on which it has agreed to provide the Reward;
b.
any statement, communication or implication
arising from any revocation, suspension or restriction of the use of the Card;
and
c.
any failure or omission to notify the Member
of any changes in the terms and conditions of this Agreement, Rewards Guide,
participating companies, Qualifying Purchases and The Points awarded for
Qualifying Purchases.
