1.0 General
Personal data
means information in respect of commercial transactions that relates to
directly or indirectly to a Data Subject, who is identified or identifiable
from that information or from that and other information in the possession of a
data user, including any sensitive personal data, and expression of opinion
about the Data Subject. Such personal information about or which identifies
individual(s) who is the Data Subject, includes but not limited to
individual(s)’ names, addresses, identity card, passport numbers, telephone
and/or fixed line numbers, photographs, and email and/or social media
addresses.
Processing in
relation to personal data means collecting, recording, holding or storing the
personal data or carrying out any operation or set of operations on the
personal data.
Sensitive
personal data means any personal information consisting of information
including but not limited to the physical or mental health or condition of a
Data Subject, their political opinions, their religious beliefs or other
beliefs of a similar nature, the commission or alleged commission by them of
any offense or any other personal data.
Data Subject
refers to an individual who is the subject of the personal data.
2.0 Notice and Choice
First Emporium & Supermarket collects
personal data directly from the Data Subject, and in this context, from you
through registration or feedback form or any contest participation.
First Emporium & Supermarket
processes various types of personal data including but not limited to
individual’s names, addresses, identity card, passport numbers, telephone
numbers and/or fixed line numbers, photographs and e-mail addresses and/or
social media addresses.
First Emporium & Supermarket
shall process the personal data for the following purposes (which may also
include purposes directly related to the said purposes):

Providing you with
service under First Emporium &
Supermarket ‘s business which includes any matters relating to exchange of
goods or services;
●
Processing your
application or registration under any First
Emporium & Supermarket program; and for the purpose of exercising or
performing any right or obligation which is conferred or imposed by law on First Emporium & Supermarket in
connection with candidates for employment including personal data relating to
other individuals who may be identified from the personal data.

First Emporium & Supermarket
may disclose personal data to third parties for legitimate business purposes,
including for the following purposes or in the following circumstances: –

Background verification
checks on candidates for employment;
○
Relating to advertising,
publicity, marketing and communication related to First Emporium & Supermarket;
○
For the purposes of
exercising or performing any rights or obligation which is conferred or imposed
by law on First Emporium &
Supermarket in connection with candidates for employment including any
referee whose personal data are provided by you; and
○
Making such disclosures
as may be required by law or by order of a court of competent jurisdiction or
by any rule, direction or regulation of any regulatory or governmental
authority or any other relevant authority to be disclosed.

First Emporium & Supermarket would
like to notify that it’s obligatory for you to supply the personal data in
order for us to provide you with services which includes any matters relating
to exchange of goods or services, to process your application or registration
under any First Emporium &
Supermarket loyalty program, and
to process your application in relation of employment application under First Emporium & Supermarket. First Emporium & Supermarket will
not be able to provide you with the adequate services if you fail to supply the
personal data.

Where sensitive personal
data is provided, and disclosed by you to First
Emporium & Supermarket, by such disclosure, you have consented to its
collection and processing by First
Emporium & Supermarket.

You hereby represent
that if at any time you have provided, and disclosed to First Emporium & Supermarket personal data about other
individuals, you are authorized to do so, and you are aware that First Emporium & Supermarket may
use, and/or process such personal data for the relevant purpose as set out in
“ITEM 3” above.

You may notify in
writing to First Emporium &
Supermarket, to withdraw your consent to or limit the processing of
personal data in respect of which you are the Data Subject. First Emporium & Supermarket shall upon receiving the written notice cease
or limit the processing of the personal data accordingly. Please refer to the
“Access” section below for the communication methods available.
3.0 Disclosure
Personal data
shall not without your consent be disclosed for any purpose other than the
purpose for which the personal data was to be disclosed at the time of
collection of the personal data or a purpose directly related to it, or be
disclosed to a third party other than that specified in the “Notice and Choice”
section above.
4.0 Security
First Emporium & Supermarket shall take appropriate measures to protect the
personal data from any loss, misuse, modification, unauthorized or accidental
access or disclosure, alteration or destruction when processing personal data.
5.0 Retention
First Emporium & Supermarket retains
personal data for as long as necessary for its legitimate business purposes,
and as otherwise permitted by applicable law.
6.0 Data Integrity
Personal data
supplied by you to First Emporium &
Supermarket shall be accurate, complete, and not misleading.
7.0 Access
You have the
right to request access to your personal data processed by First Emporium & Supermarket and be able to correct that
personal data at First Emporium &

First Emporium & Supermarket Membership Programme
Terms And Conditions:
- The 1st Emporium Membership Programme (Programme)
and 1st
Emporium Mobile App (Mobile App) are
proprietary to First
Emporium & Supermarket (Company) where acceptance of any
person(s) to the Programme shall be subject to the approval of the Company
and once accepted by the Company, participation by any such person
(Member) in the Programme shall be subject to the terms and conditions
contained herein. The Programme is only accepted at Company branded
supermarket (Supermarket) situated in Brunei or the participating
merchants that registered with the Company.
2.
In order to
become a Member, the applicant must agree to the terms and conditions. The
Company reserves the right to make amendments or variations to the terms and
conditions from time to time.
3.
Participation
in the 1st Emporium Membership Programme is open to all citizens and
non-residents aged 18 years old and above.
- The application fee for a physical membership card is BND$3.00 and the renewal fee per year is BND$3.00. The E-card registration is free of charge.
- Every
transaction of BND$1.00 will be awarded 1 loyalty point. Member must spend a minimum of BND$1.00 and
above on qualifying purchases in a single transaction.
6.
Once the
Card is credited the loyalty point corresponding to the Qualifying Purchases, a
transaction receipt prepared by the cashier at the checkout counter shall be
issued to the Member. Such transaction receipt shall be conclusive record of
the Qualifying Purchases made as for the loyalty points accumulated will be
shown at the membership account within 24 hours. Member will be able to check
up to 6 months loyalty transaction available at the 1st Emporium
Mobile App.
7. Purchase of the following items are not entitled for points
awarding:
a. Gift
card/cash vouchers purchase,
b. Other
services, i.e., mobile reload, IDD reload, online game reload, e-wallet reload,
Utilities, Bills Payment, Payment to Authorities, etc.
c. Delivery
Charges, Repair & Service Charges
8.
The loyalty
point awarded and credited to the Card cannot be transferred or assigned to
another Card or any other card issued by or on behalf of the Company or
combined or aggregated with the loyalty point of such e-Card or physical card
or otherwise dealt with except in accordance with this Agreement. The loyalty point
has no cash or monetary value.
9.
Member must
present their 1st Emporium Membership Card or E-Card to cashier
before every transaction. Failure to do, no point will be awarded for the
purchase.
- 10.
The Points accumulated will expire after 1 Year
from the month of issuance. All the points will be expired/zeroised in
following month after 1 Year.
For example,
- E-Voucher has a specific validity period with expiry date
clearly stated in the E-Voucher, beyond which they cannot be used or
reissued. Additional terms and conditions may be found at the E-Voucher.
- The Member may refer to the Rewards catalogue available at 1st
Emporium Mobile App or the participating outlet for redemption, which
shall be for the purpose of information and illustration only and shall
not be construed as constituting any representation or warranty as to
their availability.
- The Company gives no representation or warranty with respect to
any products and/or services featured in the Rewards catalogue. Where the
Rewards are covered under any manufacturer's warranty, any disputes or
claims shall be forwarded directly to the manufacturers concerned.
14.
For Rewards
that are to be redeemed from participating merchants or suppliers of Rewards as
shall be appointed by the Company from time to time, the Member shall present
his/her Card and national identity card for Rewards redemption.
15.
Member who
has redeemed his/her points for any 1st Emporium rewards, i.e.,
merchant products or services, is not eligible for refund or cancellation from
the Company.
- The Member is responsible to examine, immediately upon receipt,
the Rewards for any defects or damage, whether in its packaging or
otherwise, and to verify the contents of the Rewards. Where the Reward or
its packaging is found to be damaged or defective or that the contents
therein are incomplete / damage, the redeemed item be immediately returned
to the Customer Service counter located at the respective outlet that the
member originally redeemed the reward(s).
- Company reserves the rights to reject any request for the
replacement of faulty or damaged Rewards should the Member fail to return
the same in the manner and within the time period set out as stated above.
18.
It is the
Members’ responsibility to notify the Company management of any changes of
personal particulars, lost or damaged card.
19.
Member need
to update or correct the provided personal data via 1st Emporium
Mobile App from time to time.
- The Member agree that the Personal Data may be used by Company
for the purposes below.
- To associate the Card to the Member and to update information
(if required);
- To process the application by the Member for related services;
- Management, operation and maintenance of Member's account,
system including audit and exercising the rights of the Company under the
terms and conditions;
- Designing new or improving existing services provided by
Company, our subsidiaries, associates and affiliates;
- Communication by Company to Member;
- Investigation of complaints, suspected suspicious transactions
and research for service improvement;
- Prevention or detection of crime or fraud; and
- Disclosure as required by law, rules, regulations, codes or
guidelines.
21.
Members
deemed to have subscribed to the marketing mailing list upon registered as a
‘Member’ in the App and the Company will send or deliver the marketing
information and relevant updates (“Newsletter(s)”) via push notification, SMS,
electronic direct mail (e-DM) and/or direct mail (DM).
22.
The Member
may terminate his/her membership anytime by giving notice in writing to the
Company. However, there will be no refund of points collected in any form for
termination of membership.
- Any abuse or fraud with respect to The Points under
the Programme or redemption of Rewards will result in the cancellation of
the Member's participation in the Programme, cancellation of the Card and
revocation of The Points or return of redeemed Rewards (or its reasonable
compensation thereto).
24.
The Company
reserves the right to restrict, suspend, or change the features and benefits of
the membership programme, including the terms and conditions from time to time
without prior notice or assigning any reasons.
- The Company shall not be liable for any loss of accumulated The
Points or loss or damage suffered as a result of any defect or error in
any machines or inability to retrieve any information or data from the
computer system.
- The Company
shall not be liable howsoever for any errors, delays, loss or damage,
which may be directly or indirectly due to breakdown, failure of machinery
or the processor; or industry dispute, war, act of God, system failure and
anything outside the control of the Company.
- The Company
shall not be liable for any loss or damage suffered by the Member due to
the following reasons:
- any failure by the Reward supplier to abide by the terms and
conditions on which it has agreed to provide the Reward;
- any statement, communication or implication arising from any
revocation, suspension or restriction of the use of the Card; and
- any failure or omission to notify the Member of any changes in
the terms and conditions of this Agreement, Rewards Guide, participating
companies, Qualifying Purchases and The Points awarded for Qualifying
Purchases.
28.
A Member is
required to contact the Company
hotline at +6738777880 in the event of any query.
- The laws of Brunei shall govern this Agreement
between the Company and the Member. The parties hereby submit irrevocably
to the jurisdiction of the Courts of Brunei.
