A.      INTRODUCTION

1.      The Personal Data Protection Act 2010 (“PDPA”) was enacted by the government to regulate the processing of personal data. Therefore, EVERRISE is committed to ensure that your personal data is protected in accordance with the relevant laws.

2.      This Privacy Notice (“Notice”) is issued to all our valued customers and/or prospective customers and/or business partners and explains how we collect and handle your personal data in accordance with the PDPA.

3.      In accordance with Section 7(3) of the PDPA, this Notice is issued in both English and Bahasa Malaysia. In the event of any conflicts or discrepancies between the English version and the Bahasa Malaysia version, the English version shall prevail.

4.      EVERRISE shall have the right to modify, update or amend the terms of this Notice at any time by placing the updated Notice on our website (http://www.everrise.com.my) or through other appropriate means. If EVERRISE amends this Notice, the amendment will only apply to personal data collected after EVERRISE has posted the revised Notice. By continuing to communicate with EVERRISE or by continuing to use EVERRISE’s services following the modifications, updates or amendments to this Notice, it shall signify your acceptance of such modifications, updates or amendments

B.      DEFINITION

1.       “Personal Data” means any information in respect of commercial transactions that relates directly or indirectly to the data subject, who is identified or identifiable from that information or from that and other information in our possession, including any sensitive personal data and expression of opinion about the data subject, which we collect.

2.        “Sensitive Personal Data” means any personal data consisting of information as to the data subject’s physical or mental health or condition, political opinions, religious beliefs or other beliefs of a similar nature, and the commission or alleged commission of any offence.

 “Data Subject” means an individual who is the subject of the Personal Data.

C.      PERSONAL DATA THAT WE COLLECT

1.       Personal Data that we collect includes but is not limited to the following:

Customers

·         Personal details such as name, IC number, age, birth date, race, address, gender, occupation, telephone number, mobile telephone number, email address etc;

·         Your image by way of video surveillance installed in certain parts of our premises as part of our security infrastructure;

·         Your image captured by camera or video when you attend promotional or other events held at our premises or otherwise organized by us, or captured as part of a promotional contest or other marketing activities; and/or

·         Information automatically collected when you visit our website such as IP address, web browser, software, transaction information and other information.

Business Partners (vendor, supplier, tenant or service providers)

·         Your personal details or that of your employees such as name, IC number, address, gender, telephone number, mobile telephone number and email address, and other details as is necessary for the conduct of the business transaction between you and us;

·         When you visit our premises, your image by way of video surveillance in certain parts of our premises as part of our security infrastructure;

·         Your image captured by camera or video when you attend promotional or other events held at our premises or otherwise organized by us; and/or

·         Information automatically collected when you visit our website or use the platforms that we provide to our business partners for purpose of conducting the relevant business transaction between you and us, such as IP address and other information.

2.       The provision of your Personal Data to EVERRISE may be voluntary or mandatory in nature depending on the purposes for which your Personal Data is collected. Where it is mandatory for you to provide us with your Personal Data, and you fail or choose not to provide us with your Personal Data, or do not consent to this Notice, we may not be able to:

            Customers

·         Conduct or complete the relevant sale and purchase transaction (including online transactions) with you;

·         Process or perform your request;

·         Approve or continue your EVERRISE Card membership;

·         Process your application for contests or redemption of complimentary gifts; and/or

·         Provide you with the information, updates, products or services that you have requested.

Business Partners (vendor, supplier, tenant or service providers)

·         Conduct or complete the relevant business transaction with you;

·         Allow you entry into our premises or events, for security purposes; and/or

·         Allow you use of our platforms provided to our business partners.

3.       If you do not want your Sensitive Personal Data to be collected by us, please do not submit it. If you do choose to submit your Sensitive Personal Data to us as requested, such data shall then be deemed to be and will be treated by us as Personal Data which will be subject to the terms and scope of this Notice including for the collection, processing, use and disclosure of your Personal Data.



D.      HOW IS YOUR PERSONAL DATA BEING COLLECTED

Customers

·         When you apply to be a member of EVERISE Card or register your interest with us to obtain information and updates on any products and services, whether in physical hardcopy or electronically;

·         When you enter contests or respond to our surveys, promotions or questionnaires, whether in physical hardcopy or electronic copy;

·         Pursuant to any inquiry, complaint, request or communication made with or to us, whether in physical hardcopy or electronically (including through our website or other platforms);

·         When you visit our premises or attend events organized by us (in relation to CCTV images, other camera/ video images and other personal details collected for security purpose);

·         When you submit your information on our website; and / or

·         Through the use of cookies on our website and other internet platforms.

Business Partners (vendor, supplier, tenant or service providers)

·         When you send us completed application forms, workers’ list, and any other forms, documents or details pursuant to any business transaction or proposed business transaction with us, whether in physical hardcopy or electronic copy;

·         When you visit our premises or attend events organized by us (in relation to CCTV images, other camera/ video images and other personal details collected for security purpose); and/or

·         Through the use of cookies on our website, and also through the use of other platforms provided to our business partners.

E.      PURPOSE FOR COLLECTING, PROCESSING AND USING YOUR PERSONAL DATA

1.       EVERRISE may use and process your Personal Data for the purposes relating to the services you have requested and for the business activities of EVERRISE which shall include:

Customers

A.     To communicate with you, including in relation to our products, contests and events;

B.      To process your applications, inquiries, requests and purchases (including online transactions, if applicable);

C.      To provide information, updates on our, or other, products and services;

D.     For database(s) record keeping, maintenance and updating;

E.      For administrative purposes including audits, fraud monitoring and prevention of crime;

F.       To conduct research and statistical analysis;

G.     To otherwise market and promote our products and services offered by us from time to time;

H.     To ensure the security and safety of the premises (in relation to CCTV images and other details collected for security purposes);

I.        For credit card application with financial institutions, only as allowed by you (in cases of joint campaigns and promotions);

J.        To comply with any applicable laws, proceedings or inquiries from regulatory authorities and enforcement agencies; and / or

K.     For all other purposes incidental and associated with any of the above and/or required or permitted under the PDPA.

Business Partners (vendor, supplier, tenant or service providers)

A.     To fully and properly conduct the relevant business transaction with you;

B.      To process any payment related to the relevant business transaction with you;

C.      For insurance purposes;

D.     For database(s) record keeping, maintenance and updating;

E.      For administrative purposes including audits, fraud monitoring and prevention of crime;

F.       To ensure the security and safety of the premises (in relation to CCTV images and other details collected for security purposes);

G.     To promote our products and services offered by us from time to time, and our company (in relation to images and other Personal Data captured during attendance at events organized by us);

H.     To comply with any applicable laws, proceedings or inquiries from regulatory authorities and enforcement agencies; and / or

I.        For all other purposes incidental and associated with any of the above and/or required or permitted under the PDPA.

F.      DISCLOSURE

1.       To facilitate the purposes stated above, we may disclose your Personal Data to the following classes of third parties:

A.     Our subsidiary companies;

B.      Selected financial institutions (in relation to credit card applications, only as allowed by you (in cases of joint campaigns and promotions));

C.      Our advisors, auditors, consultants, contractors, products and service providers, only on a need to know basis;

D.     Regulatory authorities, enforcement agencies and any relevant parties in connection with any legal proceedings; and/or

E.      Any actual or potential assignee, transferee or acquirer of the company or pursuant to any corporate restructuring exercise.

G.     SECURITY OF YOUR PERSONAL DATA

1.       We will use all reasonable endeavors to ensure that the processing of your Personal Data is carried out in the following manner:

A.     Your Personal Data is only processed by our authorized personnel;

B.      We maintain physical security such as locks and security systems over Personal Data that are being kept in paper and electronic data stores, and on our premises;

C.      We maintain computer and network security such as the use of anti-virus programs, passwords etc;

D.     We maintain and monitor our online security systems to ensure your Personal Data is protected; and /or

E.      We will reasonably endeavor to impose and ensure the same level of obligations on our service providers or other data processors, that may process your Personal Data.

H.     USE OF COOKIES

1.       When you visit our website or use our services through our web portal, our web portal may create a “cookie”. A “cookie” is a piece of information stored on our hard drive containing information of your computer. The “cookie” enables our system to recognise your browser and remember your name and billing information and other information so that you won’t have to retype it on your next visit.

2.       A session ID cookie expires when you close your web browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove the persistent cookie by following directions provided in your respective web browser.

Our website may contain links to other websites. Please be aware that we are not responsible for the privacy practice or content of those sites. We encourage you to read the privacy policy of each site that collects information from you. This Notice applies solely to information collected by us. If for any reason you choose to access other websites linked to our website, you do so at your own risk. We shall not be held responsible for how these outside parties collect, use, protect or disclose the information you provide them.

J.      HOW LONG IS YOUR PERSONAL DATA BEING KEPT BY US

1.         Your Personal Data will be kept by us for the duration that is necessary to carry out the purpose of which your Personal Data was collected and also for other purposes set out in this Notice. We are also bound by legal, tax, regulatory and industry requirements or guidelines for keeping records and retention of your Personal Data.

K.     ACCESS, CORRECTION REQUESTS AND INQUIRIES

1.         Subject to any exceptions under applicable laws, you have the right to request for access to, request for a copy of and request to update or correct your Personal Data held by us. You also have the right to request us to limit the processing of your Personal Data (for example, requesting us to stop sending you any marketing and promotional materials or contacting you for marketing purposes). A.  PENGENALAN

1.       Akta Perlindungan Data Peribadi 2010 (“PDPA”) telah digubal oleh kerajaan untuk mengawal aktiviti memproses data peribadi. Oleh itu, EVERRISE akan memastikan bahawa data peribadi anda dilindungi mengikut undang-undang yang berkaitan.

2.       Notis Privasi (“Notis”) ini diberikan kepada semua pelanggan dan/atau bakal pelanggan serta rakan kongsi perniagaan yang dikasihi untuk menjelaskan cara kami mengumpul dan menangani data peribadi anda mengikut PDPA.

3.       Mengikut Seksyen 7(3) PDPA, Notis ini dikeluarkan dalam Bahasa Inggeris dan Bahasa Malaysia. Sekirannya terdapat sebarang ketidakseragaman atau percanggahan antara versi Bahasa Inggeris dan Bahasa Malaysia, versi Bahasa Inggeris akan digunapakai.

4.       EVERRISE berhak untuk mengubah, mengemaskini, dan meminda Notis ini pada bila-bila masa dengan memaparkan Notis yang telah dikemaskini pada laman web kami (http://www.everrise.com/my) atau melalui cara-cara lain yang bersesuaian. Jika EVERRISE meminda Notis ini, pindaan itu hanya akan dipakai ke atas data peribadi yang dikumpulkan selepas kami memaparkan Notis yang terpinda. Anda dianggap sebagai telah menerima dan bersetuju kepada pemindaan tersebut jika anda terus berkomunikasi dengan kami atau menggunakan perkhidmatan kami selepas pengemaskinian, pengubahan atau pemindaan pada Notis ini.

B.  DEFINISI

1.       "Data Peribadi" bermaksud mana-mana maklumat dalam milikan atau kawalan kami yang berkaitan secara langsung atau tidak langsung kepada anda (atau mana-mana individu lain) di mana anda (atau individu lain) dikenalpasti atau boleh dikenalpasti daripada maklumat itu atau maklumat lain dalam milikan kami.

2.       "Data Sensitif Peribadi" bermaksud apa-apa data peribadi yang mengandungi maklumat tentang kesihatan fizikal atau mental Data Subjek itu atau keadaan, pandangan politik, kepercayaan agama atau kepercayaan lain yang serupa, dan apa-apa kesalahan yang dilakukan atau didakwa dilakukan.

3.       "Data Subjek" bermaksud seorang individu yang menjadi subjek Data Peribadi.

C.  DATA PERIBADI YANG KAMI KUMPUL

1.       Data Peribadi yang kami mengumpulkan termasuk tetapi tidak terhad kepada yang tersebut:

Pelanggan

A.     Maklumat peribadi seperti nama, nombor kad pengenalan, umur, tarikh lahir, kaum, alamat, jantina, pekerjaan, nombor telefon, nombor telefon bimbit, alamat e-mel, nombor kad kredit dan lain-lain;

B.      Imej anda melalui video pengawasan yang dipasang di bahagian-bahagian tertentu di dalam premis kami sebagai sebahagian daripada infrastruktur keselamatan kami;

C.      Imej anda yang diambil oleh kamera atau video apabila anda menghadiri acara promosi atau acara lain yang diadakan di premis kami atau selain daripada itu dianjurkan oleh kami, atau yang diambil sebagai sebahagian pertandingan promosi atau aktiviti pemasaran lain; dan/atau

D.     Maklumat yang dikumpul secara automatik apabila anda melawat laman web kami seperti alamat IP, pelayar web, software, maklumat transaksi dan maklumat lain.

Rakan Kongsi Perniagaan (vendor, pembekal, penyewa atau pembekal perkhidmatan)

A.     Maklumat peribadi anda atau pekerja anda seperti nama, nombor kad pengenalan, alamat, jantina, nombor telefon, nombor telefon bimbit, alamat e-mel dan maklumat lain yang diperlukan untuk menjalankan transaksi perniagaan antara anda dengan kami;

B.      Semasa anda melawat ke premis kami, imej anda melalui video pengawasan yang dipasang di bahagian-bahagian tertentu di dalam premis kami sebagai sebahagian daripada infrastruktur keselamatan kami;

C.      Imej anda yang diambil oleh kamera atau video apabila anda menghadiri acara promosi atau acara lain yang diadakan di premis kami atau selain daripada itu, yang dianjurkan oleh kami; dan/ atau

D.     Maklumat yang dikumpulkan secara automatik semasa anda layari laman web kami atau menggunakan platform yang kami menyediakan kepada rakan kongsi perniagaan kami untuk tujuan melakukan transaksi perniagaan dengan kami, seperti alamat IP atau maklumat lain.

2.       Sama ada pemberian Data Peribadi anda kepada EVERRISE adalah secara sukarela atau wajib bergantung kepada tujuan-tujuan Data Peribadi anda dikumpul oleh EVERRISE. Setakat mana ia adalah wajib untuk anda memberikan data peribadi kepada EVERRISE dan di mana anda gagal atau memilih untuk tidak memberikan Data Peribadi anda kepada EVERRISE atau anda tidak bersetuju dengan Notis, kami mungkin tidak dapat:

            Pelanggan

A.     Melaksanakan atau melengkapkan transaksi jual beli, termasuk transaksi dalam talian (online), dengan anda;

B.      Memproses atau melaksanakan permintaan anda;

C.      Meluluskan atau meneruskan keahlian Kad EVERRISE anda;

D.     Memproses permohonan anda untuk pertandingan atau penebusan hadiah percuma; dan/atau

E.      Menyediakan anda dengan maklumat, kemas kini, produk atau perkhidmatan yang anda telah memintakan.

Rakan Kongsi Perniagaan (vendor, pembekal, penyewa atau pembekal perkhidmatan)

A.     Melaksanakan atau melengkapkan transaksi perniagaan yang relevan dengan anda;

B.      Membenarkan anda memasuki premis atau acara kami, untuk tujuan keselamatan; dan/atau

C.      Membenarkan anda menggunakan platform yang kami menyediakan kepada rakan kongsi perniagaan kami.

3.       Jika anda tidak mahu Data Peribadi Sensitif anda dikumpul oleh kami, sila jangan serahkan data tersebut. Jika anda memilih untuk menyerahkan Data Peribadi Sensitif anda kepada kami seperti yang diminta, data itu kemudiannya akan disifatkan dan akan dianggap oleh kami sebagai Data Peribadi yang akan tertakluk kepada terma-terma dan skop Notis ini termasuk pengumpulan, pemprosesan, penggunaan dan pendedahan Data Peribadi anda.

D.  CARA KAMI MENGUMPUL DATA PERIBADI ANDA

Pelanggan

A.     Apabila anda memohon untuk menjadi ahli kad EVERRISE atau mendaftar minat anda dengan kami untuk mendapatkan maklumat dan kemas kini mengenai mana-mana produk dan perkhidmatan, sama ada dalam salinan fizikal atau elektronik;

B.      Apabila anda memasuki pertandingan atau memberi respons kepada kajian (survey) kami, promosi atau soal selidik, sama ada dalam salinan fizikal atau elektronik;

C.      Menurut apa-apa pertanyaan, aduan, permintaan atau komunikasi yang dibuat dengan atau kepada kami, sama ada dalam salinan fizikal atau elektronik (termasuk melalui laman web kami dan platform yang lain);

D.     Semasa anda melawati atau menghadiri di premis kami atau menghadiri acara yang dianjurkan oleh kami (untuk imej CCTV, dan imej kamera/ video yang lain dan untuk maklumat peribadi yang dikumpulkan untuk tujuan sekuriti/ keselamatan);

E.      Semasa anda memberikan maklumat anda melalui platform/ laman web kami; dan/atau

F.       Melalui penggunaan kuki (cookies) di laman web kami dan platform internet yang lain.

Rakan Kongsi Perniagaan (vendor, pembekal, penyewa atau pembekal perkhidmatan)

A.     Apabila anda menyerahkan kepada kami borang aplikasi, senarai pekerja dan mana-mana borang lain, dokumen atau maklumat yang dilengkapkan, untuk tujuan mana-mana transaksi perniagaan dengan kami atau transaksi yang dicadangkan, sama ada dalam salinan fizikal atau elektronik;

B.      Semasa anda melawati atau menghadiri di premis kami atau menghadiri acara yang dianjurkan oleh kami (untuk imej CCTV, dan imej kamera/ video yang lain dan untuk maklumat peribadi yang dikumpulkan untuk tujuan sekuriti/ keselamatan); dan/ atau

C.      Melalui penggunaan kuki (cookies) di laman web kami dan juga melalui penggunaan platform lain yang disediakan oleh kami untuk rakan kongsi perniagaan kami.

E.  TUJUAN PENGUMPULAN, PEMPROSESAN DAN PENGGUNAAN DATA PERIBADI ANDA

1.       EVERRISE boleh mengguna dan memproses Data Peribadi anda untuk tujuan berkaitan dengan perkhidmatan yang diminta oleh anda dan untuk aktiviti-aktiviti perniagaan EVERRISE yang termasuk:

Pelanggan

A.     Untuk berkomunikasi dengan anda, termasuk berhubung dengan produk, pertandingan dan acara kami;

B.      Untuk memproses permohonan, pertanyaan, permintaan dan belian (termasuk transaksi dalam talian (online), sekiranya terpakai) anda;

C.      Untuk menyediakan maklumat dan maklumat terkini mengenai produk dan perkhidmatan kami, atau yang lain;

D.     Untuk penyimpanan rekod data, penyelenggaraan dan pengemaskinian;

E.      Untuk tujuan pentadbiran termasuk audit, pemantauan penipuan dan pencegahan jenayah;

F.       Untuk menjalankan penyelidikan dan analisis statistik;

G.     Untuk memasarkan dan mempromosikan produk dan perkhidmatan yang ditawarkan oleh kami dari semasa ke semasa;

H.     Untuk memastikan keselamatan premis (berhubung dengan imej CCTV dan maklumat peribadi lain yang dikumpulkan untuk tujuan sekuriti/ keselamatan);

I.        Untuk permohonan kad kredit dengan institusi kewangan, hanya seperti yang dibenarkan oleh anda (untuk kempen atau promosi gabungan)

J.        Untuk mematuhi mana-mana undang-undang, prosiding atau pertanyaan daripada pihak berkuasa dan agensi-agensi penguatkuasaan; dan / atau

K.     Untuk segala tujuan lain yang bersampingan dan berkaitan dengan mana-mana perkara di atas dan / atau dibenarkan di bawah PDPA.

Rakan Kongsi Perniagaan (vendor, pembekal, penyewa atau pembekal perkhidmatan)

A.     Untuk menjalankan secara lengkap dan betul, transaksi perniagaan yang relevan dengan anda;

B.      Untuk memproses pembayaran berkaitan dengan transaksi perniagaan yang relevan dengan anda;

C.      Untuk tujuan insurans;

D.     Untuk penyimpanan rekod data, penyelenggaraan dan pengemaskinian;

E.      Untuk tujuan pentadbiran termasuk audit, pemantauan penipuan dan pencegahan jenayah;

F.       Untuk memastikan keselamatan premis (berhubung dengan imej CCTV dan maklumat peribadi lain yang dikumpulkan untuk tujuan sekuriti/ keselamatan);

G.     Untuk memasarkan dan mempromosikan produk dan perkhidmatan yang ditawarkan oleh kami dari semasa ke semasa, dan juga syarikat kami;

H.     Untuk mematuhi mana-mana undang-undang, prosiding atau pertanyaan daripada pihak berkuasa dan agensi-agensi penguatkuasaan; dan / atau

I.        Untuk segala tujuan lain yang bersampingan dan berkaitan dengan mana-mana perkara di atas dan / atau dibenarkan di bawah PDPA.

F.   PENDEDAHAN

1.       Untuk membolehkan tujuan yang dinyatakan di atas, kami mungkin mendedahkan Data Peribadi anda kepada kelas-kelas pihak ketiga yang tersebut:

A.     Anak-anak syarikat kami;

B.      Institusi-institusi kewangan terpilih (berhubung dengan permohonan kad kredit, hanya seperti yang dibenarkan oleh anda (untuk kempen atau promosi gabungan));

C.      Penasihat, juruaudit, perunding, kontraktor, produk dan pembekal perkhidmatan kami, hanya atas dasar 'mesti tahu' (need to know basis);

D.     Pihak berkuasa, agensi-agensi penguatkuasaan dan mana-mana pihak berkenaan yang berhubung dengan apa-apa prosiding undang-undang; dan/atau

E.      Mana-mana pemegang serah hak yang sebenar atau yang berpotensi, penerima pindahan atau pemeroleh syarikat atau menurut mana-mana penyusunan semula korporat.

G. SEKURITI DATA PERIBADI ANDA

1.       Kami akan menggunakan segala usaha yang munasabah untuk memastikan bahawa pemprosesan Data Peribadi anda dijalankan dengan cara yang berikut:

A.     Data Peribadi anda hanya diproses oleh kakitangan yang diberi kuasa oleh kami;

B.      Kami menjaga keselamatan fizikal seperti kunci dan sistem sekuriti atas Data Peribadi yang disimpan dalam format kertas dan data elektronik simpanan, dan dalam premis kami;

C.      Kami mengekalkan sekuriti komputer dan rangkaian seperti penggunaan program anti-virus, kata laluan dan lain-lain;

D.     Kami mengekalkan dan memantau sistem keselamatan online kami untuk memastikan Data Peribadi anda dilindungi; dan / atau;

E.      Kami akan menggunakan segala usaha yang munasabah untuk mengenakan dan memastikan kewajipan pada tahap yang sama ke atas pembekal perkhidmatan kami atau pemproses data yang lain, yang mungkin akan memproses Data Peribadi anda.

H. PENGGUNANAN KUKI (COOKIES)

1.      Apabila anda melawat laman web kami atau menggunakan perkhidmatan kami melalui portal web kami, portal web kami boleh mewujudkan "kuki". "Kuki" adalah sebahagian daripada maklumat yang disimpan pada cakera keras kami yang mengandungi maklumat mengenai komputer anda. "Kuki" tersebut membolehkan sistem kami untuk mengenali pelayar (browser) anda dan mengingati nama dan maklumat bil anda, dan juga maklumat yang lain supaya anda tidak perlu menaipkannya semula pada lawatan yang berikutnya.

2.      Sesi Kuki ID tamat apabila anda menutup pelayar (browser) web anda. Ada juga kuki berterusan yang kekal pada cakera keras anda untuk tempoh masa yang panjang. Anda boleh mengeluarkan kuki yang berterusan dengan mengikuti arahan yang diberikan dalam pelayar web masing-masing.

I.     PAUTAN KE LAMAN WEB LAIN

1.      Laman web kami mungkin mengandungi pautan ke laman web lain. Sila ambil perhatian bahawa kami tidak bertanggungjawab untuk amalan privasi atau kandungan laman web lain yang tersebut. Kami menggalakkan anda untuk membaca dasar privasi bagi setiap laman web yang mengumpul maklumat peribadi daripada anda. Dasar privasi kami hanya tertakluk kepada maklumat yang dikumpul oleh kami. Jika atas apa-apa sebab anda memilih untuk mengakses laman-laman web lain yang mempunyai pautan (link) dari laman web kami, anda berbuat demikian atas risiko anda sendiri. Everrise Membership Terms & Conditions

Terms & Conditions

 

1. Everrise membership is open to all individuals aged 16 years and above, with RM 10 of one-time joining fee for a physical card.

 

2. Free e-membership is available via Everrise mobile app. 

 

3. A fee of RM10 is chargeable for any replacement of lost or damaged card.

 

4. Joining fees and card replacement fees paid are not eligible for points earning.

 

5. Everrise staffs and promoters are eligible to apply for the Everrise membership. However, they are not allowed to use the member cards during working hours and strictly not on customer’s purchase.

 

6. Everrise member card must be presented at the cashier counter BEFORE each purchase to ensure all purchases are recorded and accumulated. CARD PRESENTED AFTER THE TRANSACTION WILL NOT BE

ACCEPTED FOR POINTS ACCUMULATION.

 

7. Everrise member card is not a credit card or charge card and is non-transferable. It remains the property of Everrise, to which it must be

returned to if found or requested.

 

8. 1 point is earned with every RM10 spent, excluding purchase of formula milk powder. Other exclusions may be added in the future at the discretion of the Management.

 

9. Points will expire after 2 years of the points being conceived.

 

10. Everrise member points earned are non-transferable and cannot be combined.

 

11. For every 200 points earned, members are entitled to a RM5 cash voucher. The voucher is not redeemable for cash in whole or part and is not valid after the expiry date.

 

12. Everrise point vouchers are strictly redeemable at all outlet.

 

13. Everrise bears no responsibility for the loss or damage of the member’s vouchers.

 

14. Members are required to present their Everrise member card and NRIC or passport for verification to redeem the cash vouchers..

 

15. Everrise reserves the right to utilize the database information for other purpose pertaining to the business activities.

 

16. Everrise reserves the right to amend these terms and conditions as it deems fit at its absolute discretion and without prior notice. Any new or amended terms and conditions will override the existing terms and conditions.

 

17. Everrise reserves the right to terminate the privileges and withdraw the cards from use at any time without prior notice.

 

18. Failure to observe the terms and conditions stated herein may result in termination of Everrise membership and points forfeiture.

 

19. In the event of any dispute or points discrepancy, the decision of the company is final.

 

20. Everrise's use of personal data is described in the Privacy Notice at http://www.everrise.com.my. If you wish to request for access to and/or update your personal data and/or if you have any inquiries pertaining to your personal data, please follow the instructions in the Privacy Notice. Continued participation in the Everrise Membership Card programme will be deemed as consent as per the Privacy Notice.

1. General Information

Ownership

This mobile app (“Everrise”) is owned and operated by Everrise Departmental Store Sdn. Bhd.


Access & Use

Your access to. And use of the materials contained in, the Everrise mobile app is conditional on your acceptance and compliance with the terms and conditions, notices, and disclaimers contained in this document or elsewhere on the Everrise mobile app (“Terms and Conditions”). By using Everrise mobile app, you agree to be bound by these Terms and Conditions.


Amendments

Everrise reserves the right to amend the Terms and Conditions without notice at any time. Your use of our Everrise mobile app following such changes constitutes your agreement to be bound by the new Terms and Conditions.


Registration

To register with the Everrise mobile app you must be over eighteen (18) years of age. You must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details.


Information Collected & Use of Information

Everrise collects the details provided by you on registration together with information we learn about you from your use of our service and your visit to Everrise mobile app.


By using the Everrise mobile app, you expressly accept and give your unconditional consent that we may use any and/ or disclose information about your demographics in any manner which does not reveal your identity for the purpose of marketing, promotional, strategic development, research, and customer care.


Intellectual Property

The content of the Everrise mobile app is protected by copyright, trademarks, database and other intellectual property rights. You may retrieve and display the content of the Everrise mobile app on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Everrise mobile app without written permission from Everrise.


No license is granted to you in these Terms and Conditions to use any trade mark of Everrise.


Limitations

You may not use the Everrise mobile app for any of the following purposes:

(a.) Disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material;

(b.) Transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice;

(c.) Gaining unauthorized access to other computer systems;

(d.) Interfering with any other person's use or enjoyment of the Everrise mobile app;

(e.) Breaching any laws concerning the use of public telecommunications networks;

(f.) Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.


You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:

1.) Any claim by any third party that the use of the Everrise mobile app by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;

2.) Any claim by any third party that the use of the Everrise mobile app by you infringes that third party's copyright or other intellectual property rights of whatever nature; and

3.) Any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the Everrise mobile app by you.

Availability of the Everrise Mobile App 

Although Everrise mobile app aims to offer you the best service possible, Everrise makes no promise that the services at the Everrise mobile app will meet your requirements. Everrise mobile app cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it by email at everrisecrm@everrise.com.my, and we will attempt to correct the fault as soon as we reasonably can.


Your access to the Everrise mobile app may occasionally be restricted to allow for repairs, maintenance or the introduction of new facilities or services. Everrise mobile app will attempt to restore the service as soon as it reasonably can.


Everrise Mobile App’s right to suspend or cancel your registration


Everrise mobile app may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under Everrise mobile app Terms and Conditions.


You can cancel this agreement at any time by informing us in writing. If you do so, you must stop utilising the Everrise mobile app.


The cancellation or suspension of your registration and your right to use the Everrise mobile app shall not affect either party’s rights or liabilities.


Everrise Mobile App’s Liability

The Everrise mobile app is provided by Everrise without any guarantees or warranties of any kind either express or implied, including without limitation, warranties of title or implied warranties of merchantability of fitness for a particular purpose. You must bear the risks related with the use of the internet.


Everrise will ensure that information or material included on the Everrise mobile app is accurate, reputable, and of high quality. Everrise will not be responsible for any errors or omissions or for the results obtained from the use of information or for any technical problems you may experience with the Everrise mobile app. If Everrise is informed of any inaccuracies in the information or material on the Everrise mobile app. Everrise will attempt to correct the inaccuracies as soon as it reasonably can.


In particular, Everrise disclaim all liabilities in connection with the following:

(1.) Incompatibility of the Everrise mobile app with any of your equipment, software or telecommunications links;

(2.)  Technical problems including errors or interruptions of the Everrise mobile app;

(3.) Unsuitability, unreliability or inaccuracy of the Everrise mobile app;

(4.) Inadequacy of the Everrise mobile app to meet your requirements.


To the full extent allowed by application law, you agree that we will not be liable to you or any third party for any consequential or incidental damages (including but not limited to lose of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy, and loss of data or any indirect, special or punitive damages whatsoever that arise out of or are associated to the Everrise mobile app.


Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia, and any disputes will be resolved exclusively only by the Courts of Malaysia.


International Use

Everrise makes no promise that materials on the Everrise mobile app are appropriate or available for use in abroad, and accessing the Everrise mobile app from territories where its contents are unlawful or illegal is prohibited. If you choose to access this app from locations outside Malaysia, you do so on your own initiative, and are responsible for compliance with local news.


Miscellaneous

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.


If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of the provision will not affect the validity of the remaining provisions of these Terms and Conditions., which shall remain in full effect and force.


If you breach these Terms and Conditions and Everrise mobile app ignores this, Everrise will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.


Everrise shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.


2. Everrise Mobile App’s Price and Product

Everrise shall make every effort to ensure that prices, details and sizes of products on Everrise mobile app are up to date. Prices are subject to change without prior notice and all orders are subject to Everrise mobile app acceptance at its sole discretion and stock availability. Everrise shall ensure products displayed on the Everrise mobile app are in stock. If from time to time products become temporarily out of stock, Everrise reserves the right to offer alternative products with similar value and range to you.


Prices charged for purchases on Everrise mobile app may be different from those charged in Everrise physical stores. The prices charged are those applicable on the day you order. When ordering goods by weight, Everrise mobile app reserves the right to supply goods with a weight difference (+/-10%). However, Everrise mobile app shall make every effort to ensure the weight difference is minimal and as close to your request.


All orders are subject to confirmation of final availability and Everrise mobile app reserves the right to reject the order in the event that any of the products or services is unavailable. In the event that Everrise mobile app is unable to fulfil any of the products or services in your order, Everrise mobile app will notify you by phone or email.


All pictures and images of the products displayed on Everrise mobile app are for illustration purposes in order to help you to recognize the products only. The actual size, dimension, and color of the products may differ.


3. Everrise Mobile App’s Products Order

Once you have selected a product that you wish to order through Everrise mobile app, you will then be shown on the Everrise mobile app the charges you must pay including delivery charges. Everrise eStore purchase required a minimum spending per order of RM 50.00, which excluding the delivery charges. You shall pay for the order in full at the time of ordering by supplying us with your payment options acceptable by us. Everrise shall not be obliged to supply the product to you until the Everrise mobile app has accepted your payment for the order. Until the time when Everrise mobile app accepts your payment of the order, Everrise reserves the right to refuse to process your order or hand the products to you. Everrise reserves the right to cancel your order if any dispute or potential fraud is found.


4. Everrise Mobile App’s Stock Availability

The availability of the goods presented on Everrise mobile app depends on stock in stores, and Everrise does not guarantee the availability of goods. In order to ensure that goods are available to all customers, Everrise has the right to limit the maximum purchase quantity of the individual product by single customer. You shall always be notified in advance should the goods requested cannot be delivered by reason that it has exceeded the maximum or restricted limit.


If the goods requested are unavailable due to factors beyond Everrise mobile app control, Everrise shall make every effort to offer a substitute item which is closest in terms of price and type to the originally requested item. On delivery the substituted goods will be separated from the other products requested by you, and you shall be entitled to refuse to accept the substituted goods either in full or partially.


The amount for the goods that are not accepted shall not be charged to your payment card, if you have provided payment card details in advance in order to pay online. Delivery charges shall be imposed for cancellation or refund request agreed by both parties, Everrise mobile app and you.


5. Everrise Mobile App’s Product Order Cancellation

Everrise mobile app may cancel an order if the product is not available for any reason. Everrise mobile app will notify you if this is the case and return any payment that you have made. Refund will be credited into your credit card amount depending on the period of time your financial institution required to arrange for the refund.

You are not allowed to cancel the order once a confirmation of order is issued. If you wish to seek further information or assistance, kindly contact Everrise customer service at 082233332 (office hours).

6. Products and Payment Return/ Refund

No refunds will be given upon confirmation of order or payment. Goods (except for fresh, bread, frozen and chilled products) is exchangeable within 7 days from the purchase date.

a.) Exchange of the product can be arranged for the following reasons;

(1.) If the product is expired or damaged upon at time of delivery.

(2.) If the product is expired or damaged inside packaging after delivery and, you contact Everrise customer service within 24 hours.


For home delivery, you shall examine the goods immediately upon collection for any deficiencies and/or damages. Claims (if any) must be lodged to Everrise customer service at 082233332 (office hours) at the time of delivery; otherwise Everrise shall have the discretion to reject the exchange of product.


Everrise will inspect the returned product upon return by you. If one or more of the conditions in (a.) is fulfilled, you are entitled to choose between an exchange of the product if the product is available in our stock.


7. Payment Terms

Payment for all orders shall be made in Ringgit Malaysia (RM). Everrise mobile app shall not be liable for any credit card fraud.


Please note that Everrise mobile app does not receive cash on delivery. All product prices listed are in Ringgit Malaysia (RM). Full payment in respect of an order must be made upon the placing of the order. If your payment cannot be processed, the order will be not be accepted and you are advised to contact your card issuer to resolve any problem concerning the use of your credit card in order to continue with the order.

Everrise mobile app reserves the right to change the payment terms for any order without prior notice.

If payment for any order has already been made but the order is not accepted by Everrise mobile app, you will be entitled to a refund, depending on the period of time your financial institution needs to arrange the refund. Everrise mobile app shall not be liable with respect to any loss, damage, cost or expense that you or any person may incur as a result of any delay in your financial institution processing the said refund.


8. Everrise Mobile App’s Home Delivery

Everrise shall deliver the products to the delivery address specified based on the timeslot scheduled via Everrise mobile app. For orders that are paid before 3 noon, estimated delivery time will be on the same day. For orders that are paid after 3 noon, estimated delivery will be on the next day.  Whilst Everrise makes every effort to deliver all your goods in the agreed time, Everrise mobile app will not be liable if it fails to do so in part or in full due to circumstances beyond its control.

Your order will be delivered to you via Everrise mobile app delivery team 

Everrise mobile app delivery team will deliver your order to the main entrance of the delivery address. At your request, Everrise mobile app delivery team may carry order into the delivery address, for example, to a particular floor in an apartment block or into the kitchen but only if;

a) The driver has the customer’s permission;

b) The driver believes that it is safe and practical to do as customer requests;

c) There is no obstacle preventing entrance, for example a locked main door.


Everrise reserves the right to deliver only to the main entrance of the delivery address. If there is nobody qualified to receive the goods at the agreed time and place specified by you, Everrise mobile app delivery team will leave notification of attempted delivery, and customer will need to contact Everrise mobile app customer services to re-arrange delivery. If customer requests for redelivery, Everrise mobile app is entitled to charge an additional re-delivery fee of RM15.00 for providing the service.


If the delivery includes alcoholic drinks or any other age-restricted items, you agree to ensure that a person of 21 years of age or older with appropriate identification is present to take delivery of the alcoholic drinks or other items. Everrise mobile app reserves the right not to deliver any age-restricted product to anyone who is, or appears to be under, the age of 21 years old, and to charge the customer an additional re-delivery fee of RM15.00.

If there are any changes in the delivery address or contact details made between submission of order and delivery date, you have to contact Everrise mobile app customer service, +6082-233332 at least an hour prior to delivery.

No amendment to an order is allowed once order is processed. To add items, kindly create a second order prior to delivery and inform Everrise mobile app customer service via hotline. All amendments if agreed to surcharge or cancellation of deliveries must be confirmed via a reply through email.

Everrise deliver to selected areas with the following postal codes: 93050, 93100, 93150, 93200, 93250, 93300, 93350, 93400, 93450, 93677 and 94300 only. 


9. Delivery Charges

Everrise mobile app purchase required a minimum spending per order of RM 30.00, with RM 7.00 delivery charge per order, and purchase RM 99.00 and above will be entitle to enjoy free delivery service.
