operated by C-MART ("we", "our", or "us"). We are
committed to protecting your privacy and ensuring the security of your personal
information. This Privacy Policy explains how we collect, use, disclose, and
safeguard your data when you download, register, or use our mobile application,
physical membership system, and associated retail services.
Important Notice: By downloading, registering an account, or
using the C-MART Membership App, you expressly agree to the collection,
processing, and storage of your personal data as outlined in this Privacy
Policy. If you do not agree with these terms, please do not use the App.
1. Information We Collect
To provide you with our rewards, e-membership
functionalities, custom catalogues, and items/voucher exchanges, we process
several categories of information:
A. Information You Voluntarily Provide

Account Registration Details: Full name, email
address, mobile phone number, date of birth (used exclusively for birthday
rewards and verification), and gender.
B. Information Automatically Collected

Transaction and Point History: Details of
purchases made using your E-Membership Card, including items purchased,
date/time of transactions, total spend, point accumulations, and redemption
history for vouchers or inventory items.

App Usage Patterns: Technical log data,
including pages or product catalogues viewed, promotional banners clicked, and
session durations.
·
Device Data: Mobile device brand, operating
system version, unique device identifiers, and language settings.
2. How We Use Your Information
C-MART utilizes your personal data for clear, commercial
retail purposes, including:

Membership Operations: Maintaining your
active account, tracking point balances, and generating your secure real-time
digital barcode (E-Membership Card).

Reward Distribution: Facilitating the
seamless exchange of points for corporate vouchers or inventory items and
issuing special annual birthday rewards.

Personalized Retail Marketing:
Customizing promotional feeds, notifications, and tailored digital catalogues
based on your past purchase habits.

Operational Support: Providing customer
service, processing product returns or exchanges, and maintaining application
stability.
3. Cookies and Tracking Technologies
We use cookies, software development kits (SDKs), and
similar tracking identifiers to enhance your mobile experience. These
technologies allow us to:

Keep you securely logged into your account so
you do not have to re-enter your credentials repeatedly.

Remember your preferences, such as your language
settings and saved store locations.

Analyse app performance and usage trends (such
as which retail catalogues are viewed most frequently) to improve our services.
You can manage or restrict certain tracking permissions,
such as push notifications and data analytics, directly through your mobile
device’s system settings. However, disabling these features may impact the
functionality of certain app features.
4. Data Sharing and Disclosure
We do not sell, rent, or trade your personal data to
third-party brokers. Data sharing is limited strictly to the following
circumstances:

Subsidiaries and Affiliates: We may share your
personal data, transaction history, and preferences with our corporate
subsidiaries, parent company, and sister companies within our business group.
This sharing enables us to provide a unified ecosystem, process unified
rewards, and offer personalized cross-brand promotions or family-friendly
entertainment suggestions tailored to your interests.

Authorized Service Providers: Secure vendors
processing app hosting, point-of-sale infrastructure, SMS/email notification
gateways, and logistics partners fulfilment for physical item exchanges.

Corporate Restructuring: Shared under
non-disclosure constraints during corporate mergers, acquisitions, or asset
consolidation within the parent group.

Legal Compliance: When compelled by valid
administrative actions, court orders, consumer protection laws, or governing
regulatory entities.
5. Data Storage and Security
We deploy robust industry-standard technical,
administrative, and physical security parameters to safeguard your records
against unauthorised access, distribution, alteration, or deletion. This
includes operational database encryption, restricted internal employee data
access thresholds, and HTTPS secure transmission layers. Your records are kept
for as long as your registered membership account remains active, or as
required by applicable tax, fiscal accounting, or legal compliance mandates.
6. Your Privacy Rights & Choices
You may exercise these options directly inside the App
settings or by initiating an official support inquiry:

Access and Updates: Review or alter your profile
fields (name, phone number, email) via the profile section.
·
Marketing Opt-Outs: Turn off push notifications
or unsubscribe from promotional newsletters at any time.

Account Deletion: Request full permanent
deletion of your membership account.
Please note that deleting your profile removes accumulated
reward point structures and unredeemed vouchers completely.
7. Changes to This Privacy Policy & Acceptance of
Terms
We may modify or revise this Privacy Policy periodically to
reflect app updates, infrastructural shifts, or regulatory changes without
prior notice. Significant changes will be broadcasted to you via prominent
in-app pop-up notifications or updated version notes. The "Last
Updated" date at the top of this document denotes its current valid
enforcement timeline. Users are encouraged to review this page periodically to
stay informed about how their personal data is protected.
By continuing to access, maintain an active account, or use
the App after any revisions become effective, you explicitly acknowledge,
accept, and agree to be bound by the updated terms of this Privacy Policy. If
you do not agree to the revised terms, your sole remedy is to discontinue using
the App and request the deletion of your membership account.

C-MART Membership Programme — Terms & Conditions
Welcome to the C-MART Membership Programme. By registering
for an account, accessing, or using the C-MART Membership mobile application
("App") and its associated rewards ecosystem, you agree to be legally
bound by these Terms and Conditions. Please read them carefully.
1. Eligibility & Ownership
·
Age Requirement: The Program is open strictly to
individuals aged 18 years old and above.
·
Strict Ownership & Personal Use: The digital
membership card can only be used by its rightful, registered owner. Members are
strictly prohibited from sharing their account access or barcodes with third
parties to consolidate points or redeem items.
·
Non-Transferability: Membership accounts,
individual profiles, and accumulated reward points are entirely personal and
cannot be transferred, assigned, or shared with any other members or third
parties under any circumstances.
·
Account Limits: Only one membership account is
permitted per individual mobile number and email address. The membership
features a lifetime structure, subject to the active account parameters in
Section 5.
2. Earning Points & Exclusions
·
Standard Earning Rate: Members will earn reward
points at a baseline rate of RM1 spent = 1 point on qualified retail purchases
at all participating C-MART physical outlets.
·
Transaction Validation: To successfully
accumulate points, the E-Membership Card on the App must be scanned at the
point-of-sale checkout counter before the purchase transaction is finalized.
Points cannot be credited retrospectively for past receipts once the
transaction is closed.
·
Exclusions: C-MART reserves the right to exclude
certain transactions and items from point accumulation. Point accumulation
explicitly excludes:
o
Delivery fees, shipping charges, or logistics
service costs.
o
Gift cards, gift vouchers, bill payments, and
top-up reloads.
o
Tobacco, infant formula, or statutory items
regulated by local government frameworks.

No Cash Value Disclaimer: Accumulated points are
purely promotional indicators used to measure reward eligibility. Points do not
constitute property of the member, possess absolutely no cash currency value,
and cannot under any circumstances be exchanged, converted, or redeemed for
cash.
3. Returns, Refunds & Point Adjustments
·
Point Clawbacks on Returns: In the event that a
member returns a previously purchased product or receives a financial refund
for any transaction where membership points were originally credited, the
corresponding number of points earned from that specific purchase will be
automatically deducted or clawed back from the member's current point balance.
·
Negative Point Balances: If a member executes a
return or refund after having already redeemed their accumulated points for an
item or voucher, thereby leaving an insufficient balance to cover the required deduction,
C-MART reserves the right to adjust the member's account point balance into a
negative value, suspend account functionality, or deduct the point deficit
value from future point-earning transactions.
4. Points Expiry
·
Rolling Expiry Basis: Accumulated reward points
operate on a strict rolling 12-month expiry structure. Points earned from a
specific transaction will automatically expire exactly 12 months from the exact
date they were originally earned if they remain unredeemed. Expired points
cannot be extended, reinstated, or recovered.
·
Points are automatically deducted on a First-In,
First-Out (FIFO) basis during reward exchanges.
5. Item & Voucher Rewards Redemption
·
Finality of Exchange: Once reward points are
explicitly exchanged for a digital shopping voucher or a physical inventory
item within the App, the transaction is final, non-refundable, and
non-exchangeable. Points used will not be reversed or credited back.
·
Voucher Validity: Digital vouchers redeemed via
the App carry individual expiration terms. The specific validity period, usage
criteria, and expiration date will be clearly stated on each individual
voucher. Expired vouchers will not be replaced, extended, or accepted at
checkout counters.
·
Stock Limitations: Physical reward items
available for point exchange are subject to stock availability and may be
substituted or updated by C-MART at any time without prior notice.
6. Inactivity & Automatic Account Termination
·
12-Month Inactivity Rule: To maintain active
membership status under the lifetime structure, members must engage in purchase
activity. A member who does not make any validated point-earning transaction
for twelve (12) consecutive months will have their membership account
terminated automatically.
·
Forfeiture of Data & Balances: Upon
automatic termination due to 12 months of consecutive inactivity, all accumulated
reward points and active App vouchers within the profile will be permanently
forfeited and zeroised. Forfeited data, coupons, and balances cannot be
recovered or transferred if the individual re-registers for a new account
later.
7. Abuse, Fraudulent Use & Account Suspension
·
Monitoring and Auditing: C-MART reserves the
right to audit membership account logs and transactional history at any time
without prior notice to identify non-compliant behavior.
·
Suspension and Termination: Any detected abuse,
fraudulent activities, manipulation of transactions, copying/tampering with
digital barcodes, or misrepresentation of ownership will result in the
immediate suspension or permanent termination of the membership account. C-MART
reserves the right to cancel all accumulated points immediately and pursue
legal remedies where retail property damage or financial fraud has occurred.
8. Limitation of Liability
·
System Defect and Retrieval Disclaimers: C-MART
and the Company shall not be liable for any loss, injury, or damage suffered by
a member as a direct or indirect result of any defect or technical error in any
point-of-sale machines, mobile devices, barcode scanners, or the technical
inability to retrieve any membership information, balances, or data from the
computer networks or cloud servers.
·
Force Majeure and General Technical Breakdown:
C-MART and the Company shall not be liable howsoever for any errors,
operational delays, data loss, or physical damage which may be directly or
indirectly due to the breakdown, operational failure of machinery or backend
data processors, industrial trade disputes, war, acts of God, civil commotion,
system network crashes, security updates, or any external events completely
outside the technical control of the Company.
9. General Governance & Modifications
·
Program Changes: C-MART reserves the right to
modify, suspend, or amend any part of this Program, including the RM1 point
accumulation ratio, redemption thresholds, and operational rules, at its sole
discretion.
·
T&C Updates: Updated terms will be posted
directly within the App's information panel. It is the sole responsibility of
the member to review these Terms and Conditions from time to time. Continued
use of the App or mobile features following any adjustments constitutes full,
legally binding acceptance of the updated terms.
